    Citizenship by Birth

    Any person born in India on or after 26 January 1950 but prior to the commencement of the 1986 Act on 1 July 1987 was a citizen of India by birth.     From 3 December 2004 onwards, persons born outside of India shall not be considered citizens of India unless their birth is registered at an Indian consulate within one year of the date of birth. In certain circumstances it is possible to register after 1 year with the permission of the Central Government. The application for registration of the birth of a minor child must be made to an Indian consulate and must be accompanied by an undertaking in writing from the parents of such minor child that he or she does not hold the passport of another country.

    I was under the same impression that it was FP that triggered the name check. But this is what the lawyer told them that their names were struck in NC and that is why they never got FP and now that NC is over they received FP notices. The interesting part is that within 3 weeks of FP one person got a notice that his application has been sent to USCISlocal office for further processing which I assume means interview notice in few days.

    How does a lawyer know if u r stuck in namecheck? Unless you go to infopass you may not know.

    In reality, the app was just taken up for processing - the IO figured that FP has not yet been done and sent notice and during the course of processing the app, decided to send it for interview.

    indianindian2006, I also got OCI for my Son, issued in June 2006 (both parent Indian Citizen). I have read one case who applied in Nov 2006 and it got rejected so it seems that rule got changed sometime in 2006.

    indianindian2006, do you think we have to do anything now. I am worried that it might create issue for our kids OCI in future. It will be good to have some documentation with us.

    does any one have any reference/url to this rule change.

    In 2005 my first kid got an OCI as the rules were diiferent then but in 2009 the current rule is that one parent MUST be a US citizen and I had to take a PIO for my second kid in 2009.

    Guys,

    Is this really bad news for those with pending I-140? Does it mean they expect 140 processing to be so overloaded that they can't commit to premium?

    My 140/485 was filed in mid-Feb 07. Any ideas what to expect as far as 140 processing is concerned? I am pretty sure 485 processing will slow down as they will get busy with so many new applications and working on new EAD/AP applications.

    Do you have a link to support upgrading databases til Oct 29?

    hope you are right my friend. EB3->2 are handful (no point really in going ballistic on them).
    Thought there were lot of BECs clearing out the older PDs and that's why they are shutting doors on us. And, of course, their databases are getting upgraded so they are stalling the process till Oct 29.

    I beg to differ.. My PA DL is based on my Work Visa, hence it expires on the day my visa expires.. I tried to renew online and the system said since you are not a citizen u have to go to the DL Center for a renewal... Maybe your DL is from the time you were student or otherwise...

    The best thing about PA is through online.

    and click on renew online. Here you have to enter your details and pay through credit card. You will receive the confirmation letter (DL60A/DL60R) through regular mail with in 10 days. Take the letter and go to the DMV for photograph.

    The photograph folks don't ask any immigration documents, just the SSN original card. That's it.

    Did you had the paystubs or the immigration officer did not ask for it?

    What did you mentioned at line # 30 and # 38 of DS-156?

    How long was your wife out of status? Please respond. I am unable to get the paystubs from the employer. He is not picking up the phone.

    One of my Friend's Wife had same issue and She got H4 stamping from her country with out any problem. Visa officer asked paystub/w2's of spouse (H1b holder) and not dependent's and least bother about her previous status. Do not attach her H1b document while applying Visa.

    Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
    Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
    Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.

    What are your thoughts, is it worth filing in EB2?
    Of course, it is worth it. Go with EB-2 and don't lose hope.

    I ended-up in EB3 due to a mistake made by the lawyer back in 2001-2. Of course, we fired the lawyer, when we realized this. I wish I'd switched myself to EB-2 back then. I just didn't know of the possibility until recently, thanks to IV.

    If you have some friends who you know have successfully executed an EB-2 I-140 based on a job zone 4 occupational classification (such as software engineer), I'd consult with your friends attorneys, then switch attorneys if they think they can help you.

    xbohdpukc - very interesting. Did you get an EB-2 I-140 approval based on that software engineer occupational classification? The issue at hand is not whether the LC will get approved, that is relatively straightforward. It's whether an EB-2 I-140 will be approved based on a LC for a job zone 4 occupation.
