You are not the only one....my application was also sent on July 2nd and I got FP notices (both my wife and I) and AP approved (both my wife and I).
My wife received EAD on 10/22 and so far there has been absolutely no update on my LUD and EAD application is still pending. The service center is Nebraska and I am the primary applicant. I think there a a lot of people in the same boat.
I'm on the same boat and I scheduled an INFOPASS apt and she asked me about biometrics for my I765 and I showed the receipt which I have done for my I485. She immediately responded saying is was for I485 and you need to do one for I765 and then your EAD card will be approved. My bio is scheduled for 01/26.

Can some one clarify if the PD is based on the day labor application was received or the day it was approved?
My I140 states it as the day it was approved.
A priority date, in an employment-based (EB) case requiring Labor Certification (LC), is the officially acknowledged date that the case was filed at the state level Department of Labor office, referred to as the SESA. If the EB case was filed in a category that does not require labor certification, then the priority date assigned by the INS is the date the I-140 (Immigrant Visa Petition) is received by the INS Service Center.

I have listened to a couple of speaches by Bernake in NPR. Basically that guy is completely in the blank on how to handle the economy. He simply says, we are in this mess, because the lenders were very lenient.
Had you left your first paragraph off, may be people would have paid more attention. To say that the fed boss is clueless shows that you have simplified the problem way too much.
Have you seen the BearStearns tumble and do you understand the cause and effect it may have had if Fed/JPMC had not come to its rescue? There is a very valid speculation that it may still have a ripple effect on all mortgage brokerage firms. For now, the Fed with its tourniquet with help from JPMC seem to have tried to stop the bleeding.
And regarding your solution, the market is in a deep trouble with the 30 year loan rates around 7%. There is a very high chance that it may go up because of the risks involved in buying mortgage bonds. This is amidst news that the housing market is yet to bottom out and it may continue to fall at least for another year.
Good try, even if I had a GC, I would be a little careful to jump into this market. Ofcourse, if I had a 30% down for a 250K home, may be I might get a good deal, but not many can afford a 30% down...

I am sorry but I disagree with the "best among the best" comment. To equate success in the IIT entrance exam to being the best is a mistake. Success in the entrance exams to those Insititutions comes from focus and hard work. This does not necessarily mean that the people who go there are the best. They ARE definitely the best at preparing for the exam.
Keeping debates on "education standards" aside, from a middle-school student's perspective its definitely not easy to get into a decent higher educational institute in India; what with reservations and the enormous competition . We cannot deny that higher education opportunities are definitely better(though more expensive) in the developed countries.

I thought of leaving this company several times, but I am working in this company for 6 years and the only company I worked after coming to USA. I invested so much for this company, like working beyond work hours, working in the weekends, making up the project deadlines for the incompetitive colleagues etc. etc. and now just waiting for my Green Card. There were so many times I thought if I get my Green Card I am going to leave this moment. Years passing by and with this retrogression thing, there is very little hope of getting it soon...
The positive thing is, my direct supervisor is very nice and I can voice my opinion and she understands me and completely supports me. I am just praying god that I should keep working for her till I get the GC.
I would only say "Hang On", or move on if you can. A lot of people in same situations, never want to discuss issues openly.
Patience does help, and maybe all the good is stored for future.
Most important is how you deal with stress associated with racial slurs, difference in treatment, and all the above issues. This has direct impact on health and many people in these conditions are victims of stress.
The h1b - GC situation is well known to everyone and they know you are indentured, some managers are called problem solvers (they pretend to hear ur voice, help you from their side and get the work done and try to ease pressure off you if they have an option), whereas some managers are called problem creators (they add additional pressure on you and make u miserable so that they get the work done). The reason companies support their American workers who involve in racial slurs is to avoid issues. It is easy to kick you out and blame you rather than catering to ur problem.

Thanks you all for the responses and help. We are searching for employers who can help me out in the situation. Most of them are thinking twice bcoz I am pregnant and have to take maternity leave within a 2- 3 weeks.

I am in a similar situation , though not exactly the same. In my case I was laid off and my company is going to revoke the I-140 because the position is not there any more. I pleaded them not revoke the I-140 but they said they have to withdraw it as they do not want any liability. My company has about 30,000 employees. I also have the same question as to how I should avoid NOID or denial.
I have seen lot of people switch using AC21 but most of their employers do not revoke I-140. I have yet to see cases where a person's I-140 was actually revoked after 180 days and they were still safe and got their GC approved.
One of my co-worker was in same boat. His desi employer revoked his I-140 when he took fulltime employement in 2005. He got his GC finally.

I don't remember many a choice at the stage of I140. I guess the lawyer made it for me. I did not bother to even find out more details, given the hopeless situation so far for EB3, India.
My I140 says " The above petition has been approved. We have sent it to the Department of State National Visa Center(NVC). The NVC processes all immigrant visa petitions that need consular processing. It also determines which consular post is the appropriate consulate to complete visa processing. The NVC will then forward the approved petition to the consulate"
From the above statement, it appears that this is Consular processing. Could someone confirm if this is indeed CP.
Any idea , what needs to be done to change it to AOS. Is this a good idea?

I don't think this is true. As a CSR, case is assigned to you, not you choose the case. I think it's the same way to IOs. PD current cases will be assigned to IO, not IO looks into paper mountains to find case to adjust....

Due to huge filings in July'07, resultant chaos, and shuffling cases around between centers before entering them in the system, if your file is way below in line (eventhough you deligently made sure to have it with USCIS on July 2, AND your PD is current), no one is going to look at your file, until your turn (in order of final data entry) reaches.

Firstly I am not from India where most of your guys come from. Instead from Taiwan 2 and half year ago. As travelled much between Asia countrys, no much time staying is US office although I based here. Yes, my English is poor and broken but this is not a fake story, make no sense for me. Just kill the time???
When cops knock out your room, handcuff your hands on the back, force you stay down at the corner , if you could keep calm and state very clearly. I can only show my respect but unfortunately I did not make it. This is my first time. :( Should be the last time either.
Now the negative point is mostly from my statement, no matter whether you believe, the attorney told me drag with anger is battery. we think that's okay does not mean it is okay on the law. So I wish you guys be careful on this kind of play around to avoid any trouble. I knew you all have better english than me. so you could explain clearly :) But Same level, do it on your spouse is even worse on a stranger.
I create this thread just wish listen your opinion and try public view how much chance I can win the jury trail. Some of your advice is really helpful and I will take them.
My wife is writing the mail to DA and wish it helpful to my case. I will have several rehearsal with my attorney in coming weeks. Anyway, we will fight for the justice and not accept that ridiculous battery charge.

No need to upset. This is a different type of question. I googled and researched on it for hours, how to suggest you. In fact I did not know several words and acronyms used here.
This is a situation because of cross-cultural differences, ignorence of law of land, weaker knowledge of English, etc. It might not have been aggrivated, had you been in your native country.
Once in Japan, I crossed rails to go to next platform and caught by police for doing so. I explained them my childhood, when every day I used to do so in small town and it was OK there. Police told me that they understand me, and asked me not to repeat again there.
My son asked for Samurai. On airport, the moment police saw it, they snatched it from me. They kept it under their possession and handed over to airlines to give me back at destination.
I feel that police and people are considerate to situation.
So, based on my experience of sevaral such things happening due to ignorance and past habits:
.... Use translater and explain in native language (You can say that you know technical language to work in office, but don't know day-to-day language. You don't know difference between drag, pull, take along, etc).
.... If you have any cultural example, explaining up to what level it is acceptable in your society.
You must understand that under law of land, the way happening has been explained to police is serious offence. So work around explanation based on language gap, cultural gap, traditions gaps, etc. to minimize its impact. Show your preparedness to accept bridging of gaps to meet the law of land.

It is now game time!!
Two very significant legislative vehicles, namely the PACE bill and Comprehensive immigration bill are right on the corner. PACE is scheduled for discussion end of Feb, and the comprehensive Immigration bill beginning of March. In this dynamic legislative climate, it if very difficult to predict which of these potential vehicles could bear fruit, or even predict the timeframes accurately. IV�s strategy is to pursue both the bills and push for our goals to be on them.
We are in immediate need of funds for that very purpose. We are seriously low on gas right now, for the journey ahead that we are only just starting on. We have only raised $30,000 in the last 50 days; even more alarming, fund raising has gone down drastically in the last 2 weeks. At our current burn rate, we will be out of money in a month or so, just when we expect the bills to come up for discussion on the Senate floors. As you can expect and appreciate, there is a cost for achieving anything politically. IV has already demonstrated a great deal of leadership and persistence to work on retrogression relief and labor backlog elimination. Many IV members will start making trips to DC in the coming weeks to meet lawmakers at the hill. We need your help NOW!

If I had my green card today, I would surely be making at least 15K more in my salary per annum repeat per annum.
If not all, many of you are in the similar situation.
My $200 contribution is just 1.33% of that lost opportunity per annum. If I take into consideration the 4 years of wait, it comes to 0.33%.
Almost anybody who is in US for 5 years on H1B can buy an nice little home. (Bay area is bit more cruel).
Last year I could have bought a home for say 500K. It would have surely appreciated by 50K. But because of the uncertainty of GC, I can not. That's a loss of opportunity of 50K.
My $200 contribution is just 0.4% of that another lost opportunity.
Now you know why I support this effort.
Most of you and your friends are in a situation similar as mine.
I urge you to become aware, make them aware and support this effort, which has a potential to minimize those lost financial opportunities, with your wallet.

For illegals who entered the USA before April 5, 2001...
Immediate Adjustment of Status after paying fines and any additional amounts
Must be employed for at least 3 years during the 5 year illegal presence
Employment requirement not applicable to those under 20 years of age
Employment requirement of 3 years can be reduced if proven physical or mental disability like pregnancy
Alien shall not be required to complete employment requirements with the same employer!

So could someone explain to me why we in the retrogression queue should accept this bill even if it increases H1B and promises to reduce backlogs for GC when illegals who have been here for more than 5 years (many of us also have been here that long) get special treatment? It's a really bad deal for us.

I will just digest and summarise the interesting points:
For illegals who entered the USA before April 5, 2001...
Immediate Adjustment of Status after paying fines and any additional amounts
Must be employed for at least 3 years during the 5 year illegal presence
Employment requirement not applicable to those under 20 years of age
Employment requirement of 3 years can be reduced if proven physical or mental disability like pregnancy
Alien shall not be required to complete employment requirements with the same employer!
