    On EAD you can work multiple jobs, accept payment or stocks or compensation from any employer.

    By the way, in H1B you can accept "profit on passive investment".

    Alright so it is better then i dont take any equity at all untill i get greencard?

    what if i come on EAD ?? does it effect anything or still the same result ??

    Hello All

    Has any one else experienced this? From the two posters above (which includes me) EAD and AP efiled applications went to National Benefits Center and generated the receipt numbers starting with MSC?

    Please share your experience. Is there any thing to worry in this case?

    I just received a NOID for my 485(No LUD on the online status, received direct mail) saying that my underlying 140 is withdrawn and AC21 not filed. I have filed for AC21 last june (yes June 2009) along with my RFE (asking for G325a, Medical, Birth Certificate and 10th marksheet - this was during the Pre-adjudication time). My 140 was withdrawn by my employer as I had changed jobs under AC21 provisions(left employer in Jan 2009, filed AC21 in June 2009 and 140 withdrawn Dec 2009). Guess I will send the entire paper work again. I am EB3 India with Feb 2004 PD and I am no where near being current so I am trying to figure out if it is just me or is this the new scam that USCIS found to harass us!!!

    PS: My friend who is from the same employer, similar case (Nov 2003, EB3 with AC21 filed) also got a NOID. He responded to it yesterday. Guys, post here if you also received the same.

    Hello I am in H4 in usa.
    I have applied for change of status to H1b this year, but still now I haven't received the decision form USCIS.
    In the mean time, my H4 status along with I-94 is getting experied by the end of this month Oct. I am not able to file H4 extension as this would overlay my probable H1b status.
    Now, If I dont get any decision on my H1b and I don't file H4 extention by the end of this month, what would be status after that? Would I become Out Of Status? What should I do under this situation?

    You have 2 options

    1. Convert your h1 to premium processing and hopefully get it approved before
    your current h4 expires

    2. apply for h4 extension - and wait for your h1 application to get through

    To be really conservative - its best to file for H4 extension anyway irrespective
    of whether you convert your h1 to premium

    Dont let your h4 expire cause you wont have any valid status - if for some reason your h1 gets denied

    Hi,

    I have a question an experts:

    Shustermann says that today ist the last day that all the employment- based-preference categories are current (exception unskilled workers). Ok, now he sasy : We recommand that Employers and their attorneys e-filing their I-140 today.

    Please explain me if thats so important to file today the I-140 becouse just today the priority date are current.
    I dont understand whats has the filing form I-140 to do with the priority Dates. Priority date is the PERM date??

    Hi All,

    I would like my parents and my younger brother who is in his engineering college 2 nd yr to visit me on visitor visa. My father is a government emoployee with more than a yr job left, my mother has retired last yr and my brother has still 2yrs left for his engineering.

    1. Do you think they should raise any objection for my brother getting a tourist visa ?

    2. Should my brother's case affect my parent's case as well? I think given my father is a govt employee in India, that should work in his favor? Any thoughts.

    I have a B1/B2 visa that I'm thinking about coverting into F1 visa when I get into the US I just have few questions:

    1- How long does it take to convert the B1/B2 visa into an F1 visa?
    2- If my visa gets converted into the F1 visa, does that mean my B1/B2 visa is cancelled and I have an F1 visa or what am I?
    2- Will it be possible to leave the country for few months(after the conversion of my B1/B2 visa into the F1) and then return back to the US with ease to continue my studies ?

    Hi,

    I�m in 4th year of H1b and I485 - 180 days completed. I�m looking for full time jobs and many of the companies are asking for EAD for full time jobs and some of my friends suggested use H1b instead of EAD. Pls help me in answering the below questions

    1. What is the problem I will face if I use EAD instead of H1b?
    2. Job titles are most of them are different like Senior Software Engineer, MSI Systems Integrators, Data engineer etc, where as my appointment letter/I140 shows as a Programmer. Will it be difficult to raise AC21 though the some of responsibilities are similar.
    3. Employer can revoke I140 even If I�m working with him and crossed 180 days of I485.


    Please Advice.

    Carry all docs relevant to your current employment. Listing some.

    1. EAD/H1B petition original
    2. Employment letter from your current employer
    3. If your current employer had filed/started GC process, then those document copies

    You should be fine. When entering just answer the IO aptly. One common question is

    1. Purpose of your visit?
    2. Whom you are working for? <Be honest, tell them your current employer if asked>

    If you are traveling on AP with family the above questions will be asked only to the primary person, they don't question others who are traveling with you.

    A friend of mine has asked me to join in starting an IT training business in a densely populated Indian business area (California). The thought process is that there may be many people who have been laid off and may be wanting to learn new technologies. There are no gotchas of luring students for H1/GC etc. The primary reason is that we are experts in Microsoft technologies and we just want to impart training in this domain. However, in these hard economic times few friends have asked us to rethink about this proposition. There are 1 or 2 training institutes around, but we feel we have edge over others in few ways. And we are not eying for a big market share.

    Further to it, we want to launch other products once the training is established.we were just looking for a platform. We feel the training will give us that platform.

    Unlike other training organizations who propose free training and then H1/GC etc, we just intend to impart training and that's it no strings attached.

    Plain simple if you could give a honest opinion on this business proposition that would be great. Proposing this topic to analyze argue and know the others perspective.

    This is just to solicit feedback and analyze a startup option and please do not jump guns on saying that this is going to be a bodyshopping company then will recruit H1 etc.

    I think that it was a trial balloon. I have seen this pattern for most of the major issues this administration is planning to tackle. Take TARP for example...for a month one would just hear leaks about proposed solutions. Media would pick it up and give a reaction, the next leak would be an updated version based on the feedback. Such articles help keep the issue in the forefront, help gauge the reaction (both positive and negative) and provide a simple exit to backtrack incase of major opposition. :rolleyes:

    I think you need to wait till you have EB2 numbers available or else you need to with draw the inter filing before your I-140 assumes the eb3 priority date.The withdrawl my trigger RFE.That is my openion.Gurus correct me.

    Thanks for your reply. Do you think even when my visa number is available, they still put the file on hold until they approve the second 140? The second EB2 filed in December in TCS. So I need to wait long time to get it approved!!
    My company attorney really dont know a lot about this issue. I guess I need to speak with a good attorney.
    I hope we can get some help from people here.

    Totally irrelevant to this forum. Administrator please review this thread.

    I know this is irrelevant in a way but see it from a different angle for one moment. There is no other forum where you can get any information about these H1 employers who are playing games using retrogression. This is the only forum where most of the people on H1 are related to some desi consulting company and can share their experiences which would help other people who are in huge pain due to the unfair practices of their existing employers.

    I would recommend the administrators to create a separate area on this forum where people can share these experiences and find genuine employers.

    Hi guys,

    Some of may think "Wait for the actual letter to come" but I feel too nervous and just want to share my thoughts. I applied for EB5 and my I526 was approved. Then I applied adjustment of status and got an I485 RFE. Have not got the letter yet but got the email that my case is on hold right now. Can you tell me about the RFE? Is that common? Is that the first step of denial? I'm so nervous right now. I will write what they are asking when I got the letter which I'm expecting on Tuesday or Wednesday. Thank you very much.

    These days people are figiting wrong ful denials through MTRs. RFEs are common and one does not have to worry about RFE. Just wait for your letter and respond accordingly. There is no "first step" for denial - if your case is approvable it gets approved - if not it gets denied - period.

    Remember its your responsibility to turn in I94s. No one is going to ask you these when you depart the US. Submitting the i94s and using the us visit system enable correct traclking of your entry/departures. Read the instructions on the 1797 it tells you clearly what you need to do.
