    On an unrelated note, is there anything to gain from writing to congressmen and asking them to check on the case when it is current?

    What do you state in the letter while requesting them to check with USCIS? I remember some folks did write to their congressmen last year around June/july when they were current.

    Along with free india callling you also have the basic feature of calling unlimited in US for 24.99. Which looks pretty good to me. I already have a vonage service for 24.99 and it was a free upgrade to this new plan(after i called the customer service rep) and still i am paying the same 24.99 which is good.

    Thanks for the information about your Vonage plan but the question was if it is only limited to 5000 minutes. Lot's of people like me use Trueroots/ Reliance with no home line so I was thinking aloud if it is worth signing up for the service.

    What's wrong happening in PD porting case ?? Original beneficiary is able to get a visa allocated to him by claiming he was or is eligible for EB-2 ? Where is fraud in this and as you said if law allows it and what's wrong... The point was about abusing the system to get ahead in the line. In that way labor sub shares similarity with PD porting. If a person who landed yesterday fits the job profile and the law allowed it , then what's wrong.

    On the other hand if those labor are sold for a price then it is serious problem. And thats why Lab Sub was eleminated. Now thats what is going to happen (and happening) in PD porting case.

    Seeing this data and if USCIS and DOS follow quarterly spillover (as some mentioned that this is the law), then things look a lot better. But again, who knows...

    Quarterly spillover is very important for us and we should make sure that if that is what the law intends, then USCIS/DOS follow that.

    It is fine for you NOW that you received your GC now and "see" the plight of IO. You are drinking cool aid now under the awnings of Green card. It is now tough for you to understand the plight of the people on "this" side as you crossed over to the "other"side. It is the same old story of people who got their GC and Citizenship dont care about the people who are going to wait for dog long years. Imagine what would have you done, if you didn't receive your GC in 15 days time, i am sure that by this time you would have shaked the earth from heaven to hell by calling your senators, ombudsman, alderman, congressmen etc. Instead of giving advice to others to understand the plight of IO's, keep your emotions under check and encourage others to do their best. Do not post unnecessary comments.

    buddyinsd is a crap. dont even bother responding to him... his grey matter sends him a signal to go to any thread and vomit. when put in ignore he starts barking to gain attention.

    On the other hand i would strongly encourage people to do what they can do. in my example i have done what a person can do maximum and got positive results. I have even got a phone call from secretary janet's office. loosers like buddyinsd will discourage people to take action for there green card but you guys dont have to stop. it is your fight not this losser's fight.

    I-94s are submitted at the airport when you leave the country. In many cases there are no I-94s coz they have been submitted and no one thought of making copies of them before travelling out of country. I am sure I dont have all the I-94s that I ever used. I submitted them at the airport when I went out and didnt make copies.

    I think it must be ok if you dont have all of them. Can anyone advise if that's the case?
    You dont need all I-94's. They only need the last I-94. But, you will need to give copies of all the H1B visa petition. For instance, if you changed your employer then you will have new petition or even when you extend your visa.

    Well, all the jobs you mentioned in your message now falls in Zone 4 i.e. Eb3.
    Only option that person may have now is to change career altogether in the fields where desi consulting companies do not operate.

    Its not so simple though. Even after finding a good company to stick to, you should not make up your mind to remain stagnant. When you work for about 5 years, you will be faced with a situation where you are asked to take on more responsibility.
    The way things are with the current process, if you want to progress in your career and take on a new challenge (eg: database programmer to a DBA/architect), that would require a new LCA since there is a significant change in the responsibilities.
    Also at big companies, there are several lines of businesses which are structured as if they are companies by themselves. If you want to shift between LOBs within the same big company, that would also require a new LCA.

    I received the card production ordered email today morning, after 1 hr again I received a Decision email. Online status shows as "Decision" , does this mean my 485 is approved?

    In filing for I-485 no one has mentioned copy of I-140 or copy of Labor cert.

    My question is how does USCIS tally an AOS application to an already approved I-140 or labor certifcation and find out the PD for the application?

    If you read the instructions, it states clearly that you need to proivde a copy of your approved immigrant petition.

    How to find out if you name check has been done/cleared.

    Call USCIS customer service and insist that you want to speak to the immigration officer. Be persistent. IO will be able to tell you that. No need to waste time for Infopass.
