I think we should concentrate on things which are beneficial for everyone - not only EB1-2 or 3 . We should get USCIS to improve efficiency, use all visas, get applications processed according to their PD and not randomly and above all do away with the country limits which is the biggest cause of this retrogression.
When there are so many big issues pending I wonder why not concentrate on them instead.
There are so many people from all EB categories whose I-140 has been pending for more than a year. Shouldn't that be a priority also because without an approved I-140 their GC will also not be approved even if they have a PD from 2001-2002.

Kaiser started this new rule to not hire folks on EADs as of last week.
I thought, this may be the work of various vendors who fear of losing lot of their employees jumping to the Client as Full time employees. Dont know actual reason yet.

Thank you for the reply.
I am surprised by the disqualification since the Department of Homeland Security (DHS) had issued the EAD. DHS has set clear guidelines not to discriminate based on any of the authorized work documents issued by them, EAD being one of them. The I-9 form required to be filled in by every employee (citizen or otherwise) clearly mentions this.
Are you sure CapitalOne does not allow candidates who are on EAD specially when it does not require sponsorship from the employer ?
Response that I received for the above email:
Thanks for your message. The information regarding Capital One's policy on pursuing EAD card holders is correct. We are only able to pursue US Citizens or Green Card holders for these roles. I'm sorry, but we won't be able to consider your candidacy at this time.

HRs generally "quote" the policy word in every sentence they speak or write. It is a matter of interpretation. The HR may not have a decision making power and is just following what he/she is asked to do. No company has a policy that says GC or citizen, but policy can says "Authorized to work for any em ployer in the United States. I guess it is a matter of interpretation.
The HR seems to be ill informed. Many companies do accept EAD and they are quite aware of the delays in EAD renewal - and that has rarely been the basis to reject a petition.
If this is a trend then it is an issue to all, but if this is an isolated case then definitely you can look into places other than Capital One.
If you want to spend time and resources you can go to a lawyer, but you have no guarantee that you will get the job there too.

Like others have pointed out, it looks like that the numbers are being allocated in a different way from before. Does any one know of any article or discussion by a real attorney or some expert on what is going on?

My attr said that uscis does not follow any chrological order to approve cases. Rather, it takes any 485 application filed before Jan 22, 05. So, your point on "giving more time" won't work here.
This is what I did. I did not get GC yet though, but got to know where I'm at.
1. Contacated NCS numerous times and raised two SRs.
2. Took inforpass a couple of times. Infopass IOs have more detailed info about our cases.
3. Contact Senator requesting that my appln be assigned to an IO, and it was done so. It is with an IO now. Hoping and praying that my IO picks up application to approve it this week.
4. Contacted Ombudsman late last week. Hoping to get some good actions taken on my application.
5. You might consider contacting Janet Napolitino as well.

if we pursue independent applications (so both spouses have the option to stop working if they want to); is this the way it works:
- file independent I-485s.
- whoever stops working changes status to H4 or F1 (depending on what they want to do)
- if one gets approved, the other withdraws the application made as a primary and files one as a dependent (since the other persons PD would be current at that point). Some lawyers say you can interfile the spouses I-140 at this stage, others say you cant.

How is your experience with Lingo customer service. Last year, I tried to switch to Lingo and the lady at customer service is very rude. She is so tired to answer questions and asked me to get all from website. I stopped switching to them.
This is true. Lingo customer service is bad. Now I am stuck with them for 2 years. Rep was rude. Talked to the supervisor. Even he was rude. Asked him to pass me on to his manager. He refused to directly transfer to his manager.
I am even thinking of paying $100 cancellation fee and get off their service.
I am happy that Vonage came up with a good plan.

In America, Lawsuits are filed for mental agony. The agony we all go through to come out as a permanent resident is over the top.
Any issue, any matter, if there is mental agony, people here file for lawsuits. Heard in the news recently that airport security officials asked a woman to throw her baby's milk bottle and she was all over in the news and crying her wits out at the agony she had to go through just for security officials asking her throw her baby's milk bottle.
Here, our life hangs by a thread. We are used as puppets. Cheapest people on earth. And no one is there to even cover our news. Paris Hilton takes the front page and millions of people whose life's on hold is not an issue.
Where is the American Dream I ask?

Folks, first of all don't try to slam me for posting this.. Here is a note that I got from my law firm Paul Hastings.. I am subscribed to their immigration related email.. I got this today.. While this has come as a shock to me, they are still preparing to file my I485.. I did not hear this from my lawyer personally, but only through this newsletter. Yesterday, we distributed a Client Alert reporting widespread concern as to the accuracy of the Department of State's (DOS) Visa Bulletin for July 2007 and indicating the possibility that United States Citizenship and Immigration Services (USCIS) may potentially not accept adjustment of status filings for all, or a part, of July. Today, multiple reliable sources have indicated that, as early as Monday or Tuesday of next week, the DOS could issue a revised Visa Bulletin for July 2007. Most likely, some or all of the employment-based immigrant visa categories would again retrogress and may become completely unavailable. The practical impact is that USCIS would almost certainly stop accepting adjustment applications for filing if the revised Visa Bulletin indicates that immigrant visa numbers are not available.
This unexpected development would deviate from many years of agency practice. It would be devastating for companies and foreign national employees who have relied, as they are entitled to do, on the July Visa Bulletin and were anticipating the filing of adjustments throughout the month of July. We have initiated a concerted effort to aggressively address this unprecedented situation through the highest levels of the Department of Homeland Security (DHS) and the DOS. We are joined in this effort by many other organizations, and we are engaging congressional offices for assistance. Many have already agreed to speak with DHS and DOS. We will keep you updated.

Since the forecast is EB2-I will be current in a few years. Does that mean that someone with a PD of 2009 (EB2) would get the GC faster than someone with a PD of 2004 (EB3)?

The guy has sent you a generic form letter. I dont want to discourage or disppoint you and I thank you for your effort. What you did was good. What I am saying is that he probably didnt read that you are not talking about illegal immigration and borders etc. but the backlogs in the "Legal" variety.

Congrats ski_dude12. My personal opinion is that this may have delayed your greencard since July. Sometimes people get too anxious once their date is current and want to try everything that is possible to get approval. There is so much information and misinformation on forums.
i would think that you dont need to raise any SR or other action for at least 3-4 weeks from the month your PD is current.
i didnt do anything and the emails came to me by 7th of Sept

I received a SR reply in mail that my case is under additional review . MY pd is sep 05 and i am so frustrated. They also asked to check back after 4 - 9 months. Is there any body in that situation and what else can be done .. please advice..
