    AMY GOODMAN: It was called �Truth, Fiction and Lou Dobbs.� Columnist David Leonhardt wrote, �Mr. Dobbs has a somewhat flexible relationship with reality.� Leonhardt highlighted this profile about you that aired on CBS�s 60 Minutes.

    LESLEY STAHL: One of the issues he tackles relentlessly is illegal immigration. And on that, his critics say his advocacy can get in the way of the facts.

    LOU DOBBS: Tuberculosis, leprosy, malaria?

    LESLEY STAHL: Following a report on illegals carrying diseases into the US, one of the correspondents on his show, Christine Romans, told Dobbs that there had been 7,000 cases of leprosy in the US in the past three years.

    CHRISTINE ROMANS: Leprosy, in this country

    LOU DOBBS: Incredible.

    LESLEY STAHL: We checked that and found a report issued by the US Department of Health and Human Services saying 7,000 is the number of leprosy cases over the last thirty years, not the past three, and nobody knows how many of those cases involve illegal immigrants.

    [interviewing Dobbs] Now, went to try and check that number, 7,000�we can�t. Just so you know�

    LOU DOBBS: I can tell you this: if we reported it, it�s a fact.

    LESLEY STAHL: You can�t tell me that. You did report it�

    LOU DOBBS: No, I just did.

    LESLEY STAHL: How can you guarantee that to me?

    LOU DOBBS: Because I�m the managing editor, and that�s the way we do business. We don�t make up numbers, Lesley, do we?

    AMY GOODMAN: A day after the 60 Minutes report aired, Lou Dobbs discussed the issue on his program with his reporter, the CNN reporter Christine Romans.

    LOU DOBBS: Then there was a question about some of your comments, Christine, following one of your reports. I told Lesley Stahl we don�t make up numbers, and I will tell everybody here again tonight, I stand 100% behind what you said.

    CHRISTINE ROMANS: That�s right, Lou. We don�t make up numbers here. This is what we reported. We reported: �It�s interesting, because the woman in our piece told us that there were about 900 cases of leprosy for forty years. There have been 7,000 in the past three years. Leprosy, in this country.� I was quoting Dr. Madeleine Cosman, a respected medical lawyer and medical historian. Writing in The Journal of American Physicians and Surgeons, she said: �Hansen�s disease��that�s the other modern name, I guess, for leprosy��Hansen�s disease was so rare in America that in forty years only 900 people were afflicted. Suddenly, in the past three years America has more than 7,000 cases of leprosy,� Lou.

    LOU DOBBS: It�s remarkable that this�whatever, confusion or confoundment over 7,000 cases. They actually keep a registry of cases of leprosy. And the fact that it rose was because of�one assumes, because we don�t know for sure�but two basic influences: unscreened illegal immigrants coming into this country, primarily from South Asia, and the�secondly, far better reporting.

    CHRISTINE ROMANS: That�s what Dr. Cosman told us, Lou.

    LOU DOBBS: And, you know, in talking with a number of people, it�s also very clear no one knows, but nearly everyone suspects, there are far more cases of that. It is also, I think, interesting, and I think important to say, one of the reasons we screen people coming into this country is to deal with communicable diseases like leprosy, tuberculosis. The fact is, if we would just screen successfully, all of those diseases can be treated effectively, efficiently and relatively quickly.

    AMY GOODMAN: That�s Lou Dobbs on the show. The source behind the claim that there was a spike of 7,000 new cases of leprosy was a controversial medical attorney named Madeleine Cosman. In 2005, she described undocumented immigrants as �deadly time bombs, because of the diseases they bring into the country.� Cosman, who died last year, has also been criticized for these comments she made about Mexican men.

    MADELEINE COSMAN: Recognize that most of these bastards molest girls under age twelve, some as young as age five, others age three. Although, of course, some specialize in boys, some specialize in nuns, some are exceedingly versatile and rape little girls age eleven and women up to age seventy-nine.

    What is important here is the psychiatric defenses: Why do they do what they do? They do not need a jail; they need a hospital. They are depraved because they were deprived in their home country. But more important is the cultural defense: they suffer from psychiatric cognitive disjuncture, for what does a poor man do if in his home country of Mexico in his jurisdiction if rape is ranked lower than cow stealing? Of course, he will not know how to behave here in strange America. This is thoroughly reprehensible.

    AMY GOODMAN: Madeleine Cosman, that�s her quote. She actually is not a medical doctor. She�s a Renaissance author and scholar of sorts. Lou Dobbs?

    LOU DOBBS: What would you have me say, Amy? Because what�the reality is what you don�t say, is that Leonhardt�s piece was filled with errors. Secondly, Madeleine Cosman, as we learned following that report in Physicians and Surgeons, the publication, is precisely what you styled her: she is a wack�or was a wackjob. But the New York Times didn�t know that, either. If you would read the obituary for Madeleine Cosman in the New York Times�have you done that, by the way? She died a year ago, which was, by the way, a year after we had used her as a source in a report, along with other people. Did you read that obituary? Did you find that the New York Times had come to basically the same conclusion we had, that she was a credible source? Because if you read that obituary, it is glowing and filled with plaudits for Madeleine Cosman. And so�

    JUAN GONZALEZ: Well, but, Lou, I think the issue�

    LOU DOBBS: But I must�no, no. I am going to say this�

    JUAN GONZALEZ: The issue is that we, as journalists�

    LOU DOBBS: To go through a body of

Secondly, the issue of�if you want to, I mean, explode eight seconds into a whole body of discussion, fine. The reality is, I think you would agree, that if we were screening illegal immigrants, as well as legal immigrants, we would probably have a heck of a lot less in the way of tuberculosis in this country, and Hansen�s disease.

    I have two approved I-140 (NIW/TSC 06/2006 and EB1A/NSC 07/2009) and a
    pending I-485/TSC from 2007. I went infopass two weeks ago, and was told
    that my I-485 was pre-adjudicated and assigned to IO on 08/2009. The
    infopass officer kindly sent an e-mail to my IO requesting for update.
    Yesterday, I received a letter saying "We are actively processing this case.
    However, we have to perform additional review on this case and this has
    caused a longer processing time. If you do not receive a decision or other
    notice of action from us within 6 months of this letter, please call
    customer service at the number provided below."

    Does anyone received a similar letter? Is it just some letter or some problem
    with my case. I have been in this country for 11 years, used up all 6 years
    of H1b, renewed EAD three times, and tried service request, called IO, wrote
    to Senators/first lady. Not sure what else I can do...

    Ask them to connect you to the head/Senior executive. I did the same thing with my local cable+phone and was connected to a the head of their customer Service. That person connected me to more senior marketing person. That marketing person called me and emailed me to discuss. The company had no idea about Vonage plan and seemed unprepared to have a strategy to stop the exodus of its customers to Vonage.

    All of you can do the same. When more people do it, it will generate market demand and customer demand that money hungry capitalist companies cannot ignore. If you do not do it, then one company will have monopoly over this market.

    does everybody go through FBI check name or only a percentage?

    Everybody has to go through name check. A "small percentage" get stuck. Right now most of this forum is in "receipt mode". Let us wait for 1 more year to see how many scream " i am stuck in namecheck" . Just ask Indians/Chinese/Russians.

    that is actually true. My heart goes out to the people who were stuck at a date for an year and a half, and all of a sudden that date jumped two years...

    I asked my lawyer this, and he said that per a USCIS (Pearson?) memo you can change the underlying I140, but it applies to the same person. This is called interfiling. He said some people have taken this to assume that you can also request that underlying I-140 be changed across applicants, and primary-derivative names be flipped, but he is not sure if this will work, he has never done this in any case so far, and its a grey area.

    Center: NSC
    I485 RD: 07/26/2007
    I485 ND: 08/24/2007
    FP done only once in 2007 (forgot exact date).

    Follow-up:
    08/03/2010: Opened SR for primary (self)
    08/05/2010: Sent email to NSCfollowup. Got reply that this account address is for following up on open SRs.
    08/09/2010: Infopass appointment, did not get any useful info other than that case is being processed
    08/09/2010: Opened SR for Secondary (spouse)
    08/12/2010: Got response for 1st SR. Main gist of reply was that due to pending caseload in Nebraska, the processing time for my case has been extended :(. But the statement that got my attention was "Your application remains awaiting review by an Officer and you will be notified as soon as a decision is made. The Service is waiting for VISA availability." So called helpline again and was able to get to 2nd Level IO. She said that this statement is a mistake and that Visas are still available. Also confirmed that my case is with IO. However she said that I might be required to do FP again. The FP might be causing the delay.
    08/13/2010: Contacted local congressman and asked help for following up.
    08/13/2010: Send letter to Ombudsman

    Latest status: Still waiting, not sure what other action I can take.

    One can call the US consulates in other contries like canada or mex ask them if they can look up your petition number in the PIMS system. Google for the phone numbers.

    I hope that the PIMS system will be centralized. So if one consualte is able to pull it up, the same might be true for the others.

    Have there been reasons other than Pims for delays? I see a lot of 221g cases in the forums. Are these due to PIMS?

    Anyone with recent experience on h1b revalidation at chennai?

    By the way read INA about this and let us all know if there are specific provisions regarding this " EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)"

    There is no specific rule regarding "EB1-> older of ...", however, DoS made it clear in the Jun/Jul bulletin that the spill-over is given to the oldest first.

    BTW: EB1->EB2/EB3 is actually in INA.

    Does anyone have an answer or idea as to the job title employer verification letter question ? I didn't see any response as yet so I thought I'd repost the question. So far I've only seen some suggestions on other forums that suggest filing anyways without the letter and waiting for an RFE which might then coax the employer to do the necessary then, waiting for I-140 to be approved and then filing with W-2's (or paystubs -- I don't recall) or waiting 180 days, filing without the letter, switching to a new employer after the 180 days pass and then submitting the new employer's letter.


    I think you can go ahead to the HR and just ask for a letter stating that your position xxxx is still available for you and that you are paid xxxx. If not, you may receive a RFE for the letter. I have seen some people not getting a RFE for letters if they attached most recent pay stubs showing they are paid prevailing wage.

    This is the letter I got for support of my I485:

    Please be advised that Mr. XXXXXX is currently employed by our company. He has been employed with us since XXXXX.

    His position is that of a XXXXXXXXX. His annual salary is $XXXXX per year. The position of XXXXXXXXXXXX is still available for him. We intend to continue with the permanent residency process on his behalf at this time, according to all of the terms and conditions set forth in the approved PERM application. XXXXXXX salary will be at least $XXXXX per year once the permanent residency is granted.

While this has come as a shock to me, they are still preparing to file my I485.. I did not hear this from my lawyer personally, but only through this newsletter.     Update on Adjustment Filings for July

    Yesterday, we distributed a Client Alert reporting widespread concern as to the accuracy of the Department of State's (DOS) Visa Bulletin for July 2007 and indicating the possibility that United States Citizenship and Immigration Services (USCIS) may potentially not accept adjustment of status filings for all, or a part, of July. Today, multiple reliable sources have indicated that, as early as Monday or Tuesday of next week, the DOS could issue a revised Visa Bulletin for July 2007. Most likely, some or all of the employment-based immigrant visa categories would again retrogress and may become completely unavailable. The practical impact is that USCIS would almost certainly stop accepting adjustment applications for filing if the revised Visa Bulletin indicates that immigrant visa numbers are not available.

    This unexpected development would deviate from many years of agency practice. It would be devastating for companies and foreign national employees who have relied, as they are entitled to do, on the July Visa Bulletin and were anticipating the filing of adjustments throughout the month of July. We have initiated a concerted effort to aggressively address this unprecedented situation through the highest levels of the Department of Homeland Security (DHS) and the DOS. We are joined in this effort by many other organizations, and we are engaging congressional offices for assistance. Many have already agreed to speak with DHS and DOS. We will keep you updated.

    I cannot comprehend this person's thinking. We are gathering a movement here wherein there is no question of country India/China etc and this person is trying to explain how we need to behave. Nobody on the forum is here for only the GREEN card itself. That will come with time.
    Great leaders like Mahatma Gandhi inspire so many even now because they laid out a roadmap on how to tackle injustice and make the person in front of you realize his mistake (India freedom struggle) thorugh peaceful and legal path.
    We are similarly trying to gather a movement wherein we want to show the injustice meted out to so many. There are so many scenrios and you just try to single out certain people.
    When you say India is great just try to follow some princeples of its great leaders. That would give you a better perspective about IVians.
    You need to look around do some introspection.

    I consider all IVians as a family. Please dont try to break this bond by making such disruptive posts.

    1. Came here in July 1999
    2. Filed EB3 2003. Lawyer messed up and forgot the file in his cabinet for 18 months.
    3. Filed EB3 again in July 2004.
    4. Stuck in BEC.

    This is just a message to 2005/2006/2007 PD guys. Please don't think that some miracle will happen and dates will be current soon, it will take its own time. Mostly for EB2 & EB3June 2006- June 2007 guys, it will be like a lottery if the PD becomes current somewhere in 2007 Oct-Nov time. Right??
    So life is not always easy. There are people waiting since 2002-03-04.
    Don't think that life is not a FIFO always.

    Guys.. do you know why I always feel like this???

    As my parents,in laws and most of my relatives stay there. Not only mine, allmost all guys who are in the IV, they must have parents and relatives in India for sure. There is no other reason why I said India is great.

    Someone asked me to pack up... YES, I will if nothing happens;however, I will be waiting to see the progress for sure. This is July. Let's have a look over OCT bulletin after 2 months and for sure dates will move atleast 4-6 months for EB2 guys and 1 year for EB3 guys. So wait, be patient, instead of doing all this.
    Anyway, our turn will come sooner or later, so why to become impatient just seeing the JULY bulletin CURRENT and then "U".

    Mainly this is the message for 2005-2006-2007 PD guys. Please don't take it otherwise.

    My Dear Punjabi Bretheren,

    Let me help you understand why I think your question reeks not only of idiocracy, but also utter disregard for even basic moral and common sense.

    You wanted to buy a home, live in it for 2 years, sell it and make money. Nothing wrong with it. But, now that the market if not favorable to you, think you are not responsible for payment, and want to foreclose. All I'm saying is you are responsible for your actions; the act of buying a house, making sure you take care of it (read the contract where it says you are to take care and maintain the house to a reasonable standard), paying your monthly mortgage, insuring your home, and paying back the loan with interest by the end of the loan term. You signed the contract. You were ready to reap profits by the sale if there was equity on the home. Likewise you are to assume responsibility of payment if the home value depreciates. This is common sense. This is how the world has been. This is what they teach you as a kid. Why in the world are you complaining about depreciation when you knew this is a possibility when you bought the house?????????????????

    Foreclosing is not illegal. But in your case it is unethical. I'm not even sure if your lender will let you foreclose when you don't have a real financial burden to make regular payments. You are losing 20Gs only. I assume you are capable of paying your monthly payments. You want to relocate to get a better paying job. I do not think the lender will let you of the hook so easily. And why should they? They shouldn't. They should make you pay every single penny that you owe to them!

    And your questions about returning items to the store; you prove again that your a dishonest man! No, you cannot return a used item. It is wrong. Nothing legal about it. Who told you it is legal??? Now you may go back to the store and pretend like you didn't use it, or that the item is defective, and pass it off, but that's YOU!!!! In your own little dishonest mind everything that is in normal circumstances considered wrong is perfectly fine! You and your buddies here like "kumar1", "leo2606", think that it is fine to return used merchandise. You are all a bunch of dishonest people who didn't learn about right and wrong while growing up.     this thread was started to get suggestions as to what are the options open in the market..
    if someone did give an option and you dont like it, why dont u give an alternative option rather than venting out uour anger.
    No one is asking you how u feel or what is ethical and non-ethical..It seems that you are such an ethical guy who has not used a product and went ahead and returned it back to the store..If foreclosing is illegal let me know.. People here are giving pros and cons of doing a foreclosure.. i dont know if you own a house or not, and if you do.. dont know if you are having a perm job or a contract..I know so many people who own house and now they are in a fix because of housing market..I am not like other people who have already foreclosed..and btw.. why to blame the people and not the banks.. if i can own a house and pay mortgage which is quite same as a rent, i will better own a house and sell it after couple of years.. what is harm in that.. i may have mentioned about making profit by owning a house.. but i am not looking at becoming rich by living in a house for 2/3 years..Sledge_hammer and you are complaining all the way in the thread about people who are foreclosing or foreclosed.. but not spent your valuable time in letting people, reading the thread, know what are pros and cons of foreclosure and how it can affect 485..

    Same is the case here.

    Opened a SR on 10Aug2010 and got my CPO mail just today. Although I was very sceptic about following up with USCIS by opening SR etc, now I think it definitely helps. I did not get to speak to an IO or escalate my call to a supervisor, but it still worked. Until I opened SR, nothing was happening and my case status which I was checking 5-6 times a day, remained static with no LUD/HUDs.

    So, my recommendation to all those whose dates are current is to at least open a SR so that someone at USCIS looks at your file. If everything is OK and the case is pre-adjudicated, then approval will come through. Also, my guess is they have already allocated a Visa number for all those cases that are current (reason- Dates did not move too much forward in September Visa Bulletin).     If an employer has denied you work or fired you because she or he will not accept your work authorization as proof of your legal right to work in the U.S., or they only hire U.S. citizens or permanent residents, she or he is breaking the law. You need to show the employer the List of Legal Work Papers on the left. If the employer still insists on seeing a particular document, or refuses to hire you, call OSC right away.

    ...various internet job boards list numerous job postings requiring that applicants be U.S. citizens or permanent residents (or “green card” holders) only. In addition, many job postings, especially for positions in the high tech industry, express a preference for H-1B visa holders only. In most cases, it is unlawful discrimination to require job applicants to have a particular citizenship status or immigration status. An employer may require U.S. citizenship or permanent residence for a particular job only when required by law, regulation, or government contract.

    FAQ:
    2. Can’t I just require that applicants have a “green card?”

    No. A “green card only” (generally used to refer to a permanent resident card) policy will almost always violate federal antidiscrimination law.

    If you are told by an employer (verbally or in writing) that they will consider only citizens or green card holders, call the OSC hotline. They may not give you the job based on some other criteria but they will not discriminate anybody else in the future.

    If you find any job posting or ad which states that they will hire only citizens or green card holders, or explicitly declines to hire somebody with EAD, post it here. If you don't wish to, maybe somebody else can make the call.

    In most cases it would be pure ignorance on the recruiter's part. A simple phone call from OSC will clear that.

    Of course the best course is to avoid bringing up EAD in the first place. But if it comes to that, you can reach out to OSC, even if you don't have anything in writing.
