This is not new, I was advised the same by my attorneys. I have heard "internet rumors" of people successfully filing EB-2 for job descriptions such as senior software engineer and senior systems analyst, which are normally classified as job zone 4. However, I was advised by two different law firms that this is not possible. According to both attorneys I consulted, you must get a job zone 5 classification to file EB-2. Note that "information technology manager" is job zone 5, so if you're in a senior position and supervising people (e.g., a manager or even a team lead), you may be able to obtain this classification.

Has anybody filed lawsuit against uscis for EAD delays till now ? And what is the process for this, do we need a lawyer ?
You do not need a lawyer, I can guide you thru the process :) Yes, I know a few cases where plaintiff requested court to force the USCIS to issue EAD. Some people were waiting more than a year! Those cases were usually bundled with I-485 WoM. One case is well-known class action lawsuit Ngwanyia v.Ashcroft, No.02-CV-502 (D.Minn.). Government promised to issue EAD within 100 days for the class.
http://www.ailf.org/lac/lac_020905.pdf
However I think you better of waiting 90 days from the receipt date and then requesting EAD on infopass. Lawsuit is not a speedy process, the government has 60 days to respond to your complaint and that's not the end of it.

I might be wrong that is my wish.
Its 26May. I don't think they will move something in Oct right???

Hillary just cares about vote bank. The Bay area group that invited her should not endorse her.
Shame on Dems.
The short answer is most republicans voted yes for the senator Cornyn's bill to recapture the unused employment -based visas from previous years and almost all Democrats voted No (except Murray democrat from Washington voted yes for the bill. I guess Microsoft does have influencial power on the senator from Washington state)
see the info here about bill: http://www.immigration-law.com/Canada.html
Yesterday, Senator Cornyn introduced on the Senate floor Amendment 2339 to H.R. 2669, FY 2008 Budget, proposing the following temporaary relieffor the employment-based immigrants. Sadly, the bill was rejected by 55 Nays, 40 Yeas, and one No Vote. Do your want to know who voted against this bill? Click here.

We are proud of the Senators from Minnesota, Norm Coleman (R) and Amy Klochubar, by setting aside the partisan politics and casting bi-parisan support for this bill. THANK YOU, and THANK!!

With all due respect, the probelem I have with volunteers is that I don't think amtures can pull a job this big, you've got to have profesionals, somethng like a compain maneger.
I admire the courage of your guys, and think the goal is fantastic. But the way it goes, I don't see how it can be achieved.
I've learned a great deal about immigration from the forum here. I very much appreciate it. I try to give back by answering questions others may have. I think IV has been doing a great job serving as that capacity.
But you guys want do something bigger. Well, you have faith in it, I don't, at least not now, neither many others. Maybe that is why you are still asking for money and volunteers.
we have professional lobbyists. and they cost the erath.
and that is why we need contributions. as long people "don't believe" we don't succeed. it's up to you, it's your issue as much as mine. professionals cost a lot of money, and this thread is quibbling over 20 and 50 bucks. anyway who is the knight on the white horse coming to rescue us? it's just us buddy, and we have to do our best. i like your analytical thinking. we need you to join in and help. any number of volunteers is less imho...

This is not even good for long term due to hefty financial charges of insurance companies, you would not know about this until you buy one ,my sincere advice would be do not even get into this crap in US. these guys rip you off.
As I mentioned before Prudential charged 70% premiums as a finance charge every month and only 30% went to savings. It would never make sense and do n't listen to people who never owned these products before.

A bank wire from any bank in India is the simplest and cheapest way for you if you don;t have or need an nre/nro a/c. The limit has or is being raised to $200,000 from $100,000.
Also for tax purposes in USA, you can get a gift of $200,000 from your parents and upto $12000 anually from other people without a tax incident up here.(completely unrelated info to your current wire)
Also u can wire from any bank in India.
One simple suggestion which is less comlicated than all those above.
BTW you don't need rbi clearance.
You can send an overseas wire from india through your bank a/c where the cost would be minimal( only exchange rate diff and cost of wire($25-50).
Your parents can safely gift you $100,000 a year. Your bank only would need a letter from them saying its a gift.
I have tried this to repatriate my assets and it works all the time.
No need to open nre or nro a/c or anything.
ps. don;t entertain any solicitation on this site for reverse hawala or anyhthing as you don;t know who will cheat you!
just my 2 cents

USCIS stoped issuing interim EAD before years... We just been to local office this Monday and they said they don't issue it any more..
Do you have offical link to this memo??
According to June 12 2008 memo from USCIS FAQ :
If you filed Form I-765 more than 90 days ago and have not received a decision, who should you contact?
If you have not received a decision within 90 days of the USCIS receipt date and you have properly filed your EAD application, you may apply to obtain an interim EAD by appearing in person at your local USCIS District Office. You must bring proof of identity and any notices that you have received from USCIS in connection with your application for employment authorization.
PM if you want a pdf copy

We didn't hear back from you. Please let us know the information you got from USCIS. Here lot of people waiting for your post (Prabably GOODNEWS from you).
I read many places that you can attach case approval status if you have receipt number. USCIS will verify the beneficiary and will port priority date. Has anybody verified with attorney?

Under current regulations, an AP document cannot be granted to a person outside of the U.S. One hears about people who did not wait for the Advance Parole document to be issued and had someone send it to them while they were outside of the United States. This is not the accepted procedure, and if the person left without having AP or without having H1B, H-4, L-1 or L-2 status, s/he is deemed to have abandoned the I-485 Adjustment of Status application.
MurthyDotCom
While there may be some people who were allowed reentry into the U.S., either in error or on humanitarian grounds, it is risky to depart before the AP is issued. There are provisions for situations in which a person has the AP and requests an extension prior to departure, then does not rely on the AP extension to reenter the U.S., but uses it for a future trip abroad. This situation is different from leaving without having AP at all.
1. ..If we can mail the her New Advance Parole document to India.
2. Can she Leave the country while her AP in Process
You cannot mail AP to her to use it for reentry to US. Find many of your answers here

I guess using our degrees to pass on a message is a fool-proof idea. That can immediately catch on with media like flowers did. If not stoppers, we can write our message in bold colors on the degrees.
Indeed thoughtful. I'm all in for it.

Simple. really.
I personally know few guys (and gals) who have returned - to india. And I bet they have better things to do than hanging out on IV.
As of now you and us don't have better things to do other than hanging out on IV?? What is a better thing differs from person to person. This forum intended for people who want to immigrate to the US. Not for people who intend to go back to India/native countries as they do not have an intent to immigrate. Its no brainer that people in India/Romania/Bhutan do not snoop on IV. Immigration is different from investment. Period.
O M G! This is absolutely pathetic.
How can people even think that India will take over US with out manufacturing or infrastructure?
How the hell on earth does USD will become 10 Rs etc unless US is in Iraq for ever or some thing disastrous happens?
Yes right! GreenSpan's Bernanke's of US will let USD shrink for ever. Law makers in US dont care about whether the country is going down the flush or not.
Bush will amend the constitution to be the president and rip the economy with his 11 trillion war.
Keep hallucinating. What ever!
I am not an economics geek, but plain simple facts tell me that India is nothing but back office of the world and no country can be on top of the world by just being the back office.

We are working on 3-4 amendments that reduce retrogression and help with backlog candidates with longer H1 extensions (Instead of 1 year H1b extensions).
Please keep in mind the Core group has given 3 months of devoted time and its in core group's interest also to get things done.
These amendments will go into the final bill before the debate is over and we will let everyone know the time/date details just a few moments before they are being introduced, if its possible to do that.
The WSJ article was aimed with a different purpose addressing the republican candidates who have taken a strong stance against latino population and its election consequences. It would not have been good to get ourselves mentioned in article that has largely advocated illegals. We have been trying to separete ourselves from illegals. Remember???
Regarding the media exposure for us, QGA has given us Roll-Call article exclusively for IV, NBC appointment(Siva was on NBC last week on Brian Williams) etc.
Please be patient and trust us, we are in the same boat as you are and we would appreciate a little patience for a little more time please.
Thank you.

You get 3 greens from me :)
excellent post
"Happy Diwali" to anybody on this forum who accepts the Hindu faith.
I don't think wishing Happy Diwali to fellows of a common faith qualifies as hate mongering; same as a Muslim wishing a fellow Muslim "Eid Mubarak" or a Christian wishing a fellow Chrisitian "Merry Christmas" does not qualify as hate mongering.
All said and done this is an open forum where potential immigrants to this country (where there is a long history of separation of state and religion) are free to express their opinion.
USA has certainly benefited from having different cultures live together side by side (within the realm of a common civil and criminal law). Suppression of cultures is more in tune with the ertswhile Soviet policy of suppression of various cultures (Georgian, Ukrainian, the list goes on); and we all know what happpened to Soviet Russia.
There is no reason potential legal immigrants of different faith should not open a new thread to wish people of fellow faith on commonly celebrated festivals. There is no great reason to pursue political correct speak to the degree where you would have to create a common greeting message if we want to wish "Happy Diwali" to fellow Hindus.
People of different faiths certainly have the freedom to post a similar message. After all the pool of potential legal immigrants is far and wide.
And I would certainly be happy for fellow Chinese, Muslims, Chrisitians, Buddhists, Jains, Sikhs, Native Americans, Mexicans, Portuegese, Spanish, Greeks, Albanians, Croats, Serbs, Basque, Irish, SriLankan, Bangladeshis, Eritreans, Ethiopians, Somalis, Germans, French, Bralizians, Colombian, Ecuadarean, Argentinians, Chilean, Haitians, West Indians (the list is incomplete mind you) when somebody from their community puts up a message wishing their fellows the arrival of a happy community event.
The voice of these communities is the "Voice" of "Immigration". It would be foolhardy to try to suppress this voice in favor of political correct speak.
We are all working toward the same goal (pursuit of happiness); denial of one's culture and simple traditions is not in tune with this pursuit.
Just my 2 cents.
Regards.
