After you wait for 7-8 years in your category for your visa your thougths will change. I have MS from an american university + work experience. Our lawyer decided to file EB3 in 2001, they convinced the company that EB3 is easier to get approved. i am still waiting for my GC, in the mean time i have gained a lot of experience, i am still an EB3 for USCIS. There are many in a similar position.
People talk about unethical practices etc. i feel that they ones who jumped the queue and used agressive lawyer already have their green cards. Most of my friends are already thinking about citizenship (and ROI after USC..that is a different forum :)).
Its people working in multinational companies who follow the law by the book are the ones who get screwed, its just my observation and opinion ..good or bad, i dont know...
When there is a overflow, I strongly feel that it should flow to all the categories and that is called equality. Some inefficient people in Decision making authority at USCIS framed a rule on visa overflow and they are following it. If the rule is not much logical/ethical to most of the people, then anyone can voice their rights against it.
Just for example, a team consists of one project manager(EB1), two tech leads(EB2) and 6 Developers(EB3). The demand is based on no. of vacancies exists on the market, that means a lot of EB3, less EB2 and few EB1.
As per this rule, USCIS is not actually feeding the hungry.
Regarding the country quota, US is not favoring/helping the foreign countries by giving GC to those people from them. So, it makes no sense at all when it comes to immigrants but I can understand the bureaucracy behind it.
If they are implementing the country limit then it should be like 0.00001% of that country's population, I feel.

I hope they do that ..
Can i apply for 485..with 140 pending? and then switch to EAD after 6 months?
I will be completing my 9 yrs for H1 in Jan 2010...;)
Allowing people to file for 485, but not giving any GCs may be the plan.
Such a move do not bring much complaints from anti-immi groups. But this move will reduce the noise from people who have not yet filed for 485s. May be after getting EAD all those people will invest more in America.
This is maximum bang for the immigration buck from the USCIS/DOS point of view.

i am in the 3.a. situation. what does part time mean? can you really be working part time when you are a CEO, CFO, COO, CMO of a company? not that i am raising this questions... I want to continue to be in the 3.a. situation, but can the IO ask these questions? if i make revenue of $20000 (twenty thou) and profit of $2000 a year will that be considered enough for IO to think that my intention is to switch to my company after green card and hence no intention of continuing permanent employment? or is that number higher (or lower)...
I want to become a believer in your 3.a. statement... please let me know what you think.
If you are on 3a, you have neither used AC21 nor have you left your full time job (FT job that aligns with your LC). On EAD, you can do any number of jobs (ex: you can even work 2 part time jobs totally unrelated to your LC requirements ofcourse as long as you continue to be with your GC employer). Using this rationale, you should be fine starting a business and making profit in the part time.
In fact even those who were in 3 b were able to get their GC after an interview (Search for posts by the user "unitednations"). But, it's risky and best avoided.
Personally, I want to get into 3 a, but my 140 is still pending. I plan to approach my company to switch me to EAD as soon as my 140 gets approved.
PS: This is not legal advice. Please contact your attorney and do more research before taking any steps further.

Do you mean 30 credits with 3 year degree from India to complete MS?
$15K for 30 credits means $500 for 1 credit?
I did online MS degree and it took 3 years, although I could have completed it in 2.5 years. First year I completed only 1 course per sem, then I started doing 2 per sem. I took non-thesis option and the total cost was aprx 15K from ISU. Thye charge flat rate fee per subject ( aprx 3 credits) irrespective of residency requirements (you can actually do this course from anywhere in the world and it would cost the same) . This degree requires 30 total credits (one of them must be a project, so technically only 9 subjects/courses to take).

All,
IV supports AILF efforts to file the lawsuit and feels that if the lawsuit has a favourable judgement then, it will provide respite to lot of people in the Community IV represents. IV is not an organization which works with one motive and that is to get people out of the greencard mess and IV will support whoever helps its member community.
We feel that revision of Visa bulletin was not correct and AILF is absolutely correct to file a lawsuit against this directive and hence we support AILF in their bid to sue USCIS & DOS
when do u think we may hear some affirmative action in this regard?

I read in murthy.com that asking money for H1 b is illigal. below is the link for more info
http://murthy.com/news/n_hfraud.html
Fraud vs. Technical Violations
For purposes of the BFCA, fraud is defined as a willful misrepresentation, falsification, or omission of a material fact. Technical violations, essentially, are errors, omissions, and failures to comply that are not within the fraud definition.
MurthyDotCom
Examples of items that were categorized as technical violations include instances of employers requiring H1B workers to pay filing fees that are designated by regulation to be the obligation of the employer, as well as the deduction of other H1B-related fees from employees' wages, and, thereby, reducing the wages of these H1B workers to levels below the LCA wage requirement. Other technical violations included general failure by employers to pay beneficiaries at least the prevailing wage for the occupations within their particular geographic locations as listed on the LCAs, employment of H1B workers in geographic locations not covered by valid LCAs, and the benching of H1B employees. The fact that these were characterized as technical violations does not mean that, if found to be intentional, they could not fall under the definition of fraud.

siddar,
well said, you got couple of great points.
ashkam,
when a person applied his GC process 2002 EB3 with 3 years experience per say, another person 2004 EB2 with 5 years experience. How come EB2 guys is smarter then EB2. By the way lot of people in those days who applied under EB3 are well qualified and well educated. In my experience most of them are doing jobs that will easily comes under EB2.
The argument that Eb1 is preferred above Eb2 and BE2 is preferred over EB3 is absurd.
The regular yearly BE quota is distributed equally among all three categories, so then why they should not follow the same distribution for the overflow numbers?
Said that all BE3 applicants who are eligible should port there PD to EB2. Simple, when you know how the system works try to adapt to it.
Most of the EB3s who are in queue for more that 3 to 4 years may be eligible for EB2 porting (Assuming they got promotions and raises)

hebbar77,
Firstly, you are making an assumption that everybody here is from India. Secondly, justifying your statement by giving simplified explanation would not suffice. You suggested buying a country in Africa alluding that countries are up for sale which is quite insulting as suggested by an earlier poster.
Get a sense of humor, dude ;)

When law abiding persons are prevented from gun ownership; crime goes up. Because whether it is legal or not, criminals always have guns.
Actually very true. I for one have held off on buying a gun (though my wife highly disapproves of guns) simply because I dont have a GC and dont want any hassles. Besides I live in Chicago which has a ban on guns. Ironic that the maximum killings and drive by shootings happen maybe 30-40 blocks from where I live but the city doesnt allow legal law-abiding residents to own guns.

Dear All,
Can we determine to pool in at least 200,000.00 (each to contribute at least 300 dollars) so that we can at least hope for GC in few months and not years.
Please help yourself.
My contribution for April:
Donation to Support Immigration Voice (User: Caliber)
$50.00 USD for one month
Effective Date: Apr. 1, 2009 $50.00 USD
Is it a guaranty or just assumption that we get GC in few months if we pool $300 ??? sounds to me is a guaranty.. can you back this up with reasonable explanation????

You know what.... my wife called me today and said the most amazing thing.
My neighbors both sides, Italian, and Arebic, walked over today and greeted my wife by words, "HAPPY DIWALI".
You know the magic behind those words? The magic was the care they had in them to walk over and wish her.
They might not even know what Diwali means, or what it stands for, but they came regardless.
Because when ever there is Christmas, or Ramadan, we always go over to wish them...
I just dont understand why people have so much attitude towards anything, and everything.... the world is becoming smaller. So please open your eyes, and hearts a bit more and adapt the world culture....
Did Santa miss you on this past Christmas, even if you are not a Christian?
no?
then why so much strain in saying, Marry Christmas? or Happy Hannukkah? Or Eid Mubarak? or as my non Indian, Non Hindu neighbors said......
"""HAPPY DIWALI"""
