I've been having similar thoughts for quite some time. Whether I should move back to india which is a one way street or continue here waiting to get my GC, citizenship etc.
Here is my analysis of the situation without considering the emotional parameters involved
1) India is currently on a fast track to development thanks for the IT industry. There are a lot of jobs and salaries are sky rocketting. A lot of people in India are living a life in India which we can only dream of here in the US.
2) BUT I also read about the growing cost of conducting business in India. Definitely with salaries increasing by leaps and bounds, rupee appreciating against the dollar, high taxes and infrastucture cost has already got companies thinking about their businesses in India.
3) Many are thinking of moving to southeast asian countries like Singapore, malaysia, phillipines, even China.
4) Even if they dont move out I am not sure if the current trend in salaries will continue. It will definitely correct itself in next 3-4 years. Companies would tend to hire more fresh graduates than hiring experienced personnel.
4) I am not sure with all these developments how would things be in India in next few years. If I move to india and then have to move to these south east asian countries then why not be in US and ride out this turbulent period.
but then if you include the emotional factors in this equation it totally changes everything.
As of now at least I am confused about what to do but I guess every first generation that moves out of their home town has to go through the same thought process, only the immigration to US is complicating things further.
What will happen next is something for time to tell...!!

75% of the people (close to 1000 people) where I work are consultants thro (US contracting companies, tcs, infosys, etc)....we are called supplemental workers here......if this bill passes, all of us would have to stop working.....I am sure there are other companies exactly in the same boat....whats gonna happen to this country? how will the businesses run?.....this is insane

I am just wondering why in the world has someone done this stupid things... and suffer like this.

sometimes people do miss billing certain items (Ex: could have forgot to put it on the counter, etc) and get caught.
Shoplifting is the number one crime in stores and stores suffer billions of dollars losses onthese. Stores do prosecute these without any leniency. They cannot differentiate between an misunderstanding/accident with an intentional one.
This is not like india, where the owner of store is most interested in making you pay for that item or get it back if you are caught.

With today's post by a lawyer on DOS communication to USCIS to stop allocating visa numbers to India/China till OCT 1 , 08, it is clear that USCIS will never get its act straight unless we are completely united and press on for a major drive to senators to pass the visa recapture bill ( regardless of EB2 and EB3) . So let us start flooding the senators inbox, voicemail and email with letters urging them to pass the recapture bill. To that extent I request all of you double your efforts. The next session of senate, which starts next month, is a short session and we should act NOW. otherwise nothing will happen until late next year.

I agree that asking for complicated changes is a pain. But after meeting the lawmakers, I realized that this is the BEST way. Even the lawmakers agree and attest to this.
You are doing a reality check without even being there. Which, let's face it, is not really a reality check. It is more of your opinion and assumption.
Lets also not confuse facts vs opinions. The fact is that meeting lawmakers and educating them about our point of view is the key to this whole GC mess.
Let me ask you a simple question. What CAN be the "perceived benefit" from a rally like this that would make you think that it would be worth attending? Is it something like a guarantee for a GC in 2 months or a bill that passes next month that does everything we legals want? What is it?
Bringing attention to lawmakers about our plight. Bringing the issue right up to the Capitol. Bringing the issue up for even discussion in the various immigration meetings that are held every other day. Are these benefits not important enough for you?

But look at it this way......i already have my GC but i share the pain and frustration of folks who do not..if a 7 month wait process for me was frustrating - i can understand what a 7 year process would be to others like me....if people who are waiting saw the utility of the rally....there would have been more than 2,000 in DC.........but clearly they did not.......i was willing to give it a shot - but unfortunately could not and did not want to specifically postpone something else to make it to DC.......
People have been quoting Gandhi and his South Africa protests.........those were different times and different issues.........colonialism, racial discrimination etc.......if the american govt is non-responsive to the demand from 60% of its own citizens to withdraw from Iraq - how can we realistically expect it to react with super haste to our requests....besides gandhi had the courage to stand up to police brutality, get arrested etc.....in today's days and age - as white collared professionals - do we have the guts and will to do that? For example - we cannot even strike (non cooperation/ civil disobedience movement)....because we get paid by our respective private sector employers.....and our grudge is against the Govt - who do we strike against......?? and if we do strike or court arrest or adopt other forms of civil protest and by chance run up a police record in the process.......who would employ us in the future...in Gandhi's days - they did not have electronic background checks......!!
Another take - if US can have an endless source of temporary workers coming in, paying into income tax and social security taxes and medicare taxes for a few years......and going back without claiming a single dime of social benefits......its the best possible situation for US....a forever young, qualified, minimum wages (i.e prevailing wages) earning tax paying transient population supporting/ subsidizing an archaic and otherwise struggling social security and healthcare system.
another point people have been harping on (apologies for bringing this up but this is my only pet peeve amongst all the other wise great things that happen on this forum).......america's competitiveness and risk of reverse brain drain........personally - i think most people dont care two hoots about these issues - these messages and slogans are not out of a new found love for america but to create a nice "politically correct shield" for people's own private agendas (and the collective agenda of all of us) - to get a GC. Are we here to improve america's competitiveness (if that was the primary purpose of our coming here - shame on us for not staying back and improving our respective motherlands' competitiveness) or our own future - if the latter - lets call a spade a spade.........
so - whats the "so what" from my post? is it to critique what IV is doing - no! The "so what" is - unless there are drastic and dramatic measures - concrete changes are not possible........small procedural victories - maybe........drastic change.....no way!
just to take the "popular" Gandhian analogy a step further......There was Home Rule League and Congress in existence in India for a long time.....their objective was to petition the British Govt for small changes........and their ultimate goal was to get dominion status for india......only when Gandhi came on board plus supporters of other proactive forms of protest.....like Subhash Bose.....Tilak etc and the armed freedom struggle started (Bhagat Singh, Azad et al)......did Congress wake up and ask for "purna swaraj" (complete independence).......so from 1885 (founding of congress) to 1930 (Lahore Session of Congress when purna swaraj declaration was made) - nothing happened......british empire went from strength to strength.......then in 17 years - India got independence.......

You should get your EAD within 3 months of your application provided your I485 is already applied or applied along with EAD; EAD is independent of your I-140 approval.

if its a 10 year visa...i doubt there should be a concern about visa renewal.
Hopefully in 10 years you have GC and USC :)
But to answer your question...as long as you are not overstaying the 6 months there should be no legal issues. Ofcourse there is no such guarantee as it is upto the visa issuing officer's discretion

And most important thing is it's timing -- Can we believe that these orders to make visa bulletin come from none less than some big political clout to suppress / divide the cry of legal immigrants?
This confirms unless we get major reform for addressing backlog, all this idea of making 485 current is eyewash and nothing but trap for exorting money out of legal immigrants every year to pay for USCIS funding.

i am a physician from india residing in CA...got very good scores in high 90s
Waiting to apply for residency since 2 yrs ..as there is only 1 program in CA which sponser H1..cannot look for residency in east coast bcoz of my kid is very small, husband is stuck with the employer coz of GC so cannot move...
Life is getting too depressive for me..

I heard from some of my friends that places like Detroit downtown,Arkansas,St.Louis,Tennessee, Louisiana are deadly dangerous.How far this is true?
my friend, pretty much every place in US in unsafe.

Yes, the same software was used that readily available in the interest of time. This website came up in the last week of December and we are improving it everyday as much as we can.
We have our own admin who is actually a volunteer of immigration voice. Most members here are members of immigration portal that joined hands after failure of regtrogression provisions in S 1932 on Dec 21.

This favours temporary workers on H1, L1 etc. An H1/L1 spouse can move to the US easily, but not that of a GC holder. If you want to bring out this "discrimination", that would mean to discontinue H4 visas, as seeminlgly it is a discrimination against a GC holder. Is that you are looking for?
EB3 discrimination is quite blatant. Folks with a date of March 2004 should be automatically considered EB2 based on five year experience. This is not just for EB3-I or EB2-I but for all chargeabilities.
