We me and my husband took infopass on 95th day of reciept date
(11/28/2007). The USCIS officer was not that friendly, but she promised to send an e-mail to main office. The very next day (11/29/2007)we had an update on website that EAD cards were ordered and we got it today. The date on the cards was 11/29/2007. It worked for us. It is really depends on the officer you speak with.

Now specifically when u want to start a company with pending I-485 you want to determine what is that you want to do with it....Process H1's consulting, create products whatever.....
Determine what should be the structure of your company LLC, LLP, C-Corp each one has its own advantage and disadvantage......
find a CPA and register it..... Get the company registered open tax id....if you need a location, find one and sign lease, Open a bank account, Hire people.....an grow your company....:)

I would sympathize with you if you can do the following:
1) Show me that no more than 90% of the population experience depression tendencies at some point in their life.
among EB applicants I believe it would be 99%. So are you alone? I guess not:D:D
Things you could do: Try watching talks with the Dalai Lama (available on youtube). Read books on Gandhi. Increase frequency of quiteness / meditation. Watch atleast one comedy show per day. Visit/remember the sick/disabled/poor or other less fortunate people than you.
Things you could avoid: Heavy drinking. Watching news, movies/shows which are high tension. Most important is not to fight the emotions/thoughts that you consider are destructive. Allow them to come and go. Just watch them come and go........
What you consider as "Good luck" can happen to you in the fraction of a seccond, however, it will never happen if you keep on defining yourself as unlucky. So focus on the good things you have now and refrain from comparing to "what you should be having or are worthy of having". :D:D:D:D

I follow similar techniques to stay optimistic for most part of time. but every once in a while, there comes a time when I think why do some ppl get so lucky in everything they do.... they succeed in everything they do. while there are unlucky ppl like the poor/disabled etc who are destined to live unfortunate life deprived of so many things that other ppl enjoy regularly. is this what they call 'Law of Karma' ? did I do anything bad/evil in my past births - did I destroy anyone's career or life ? I am very happy for India.
1.Now most of the work that is being done here by H-1B professionals will be done in India.
2.Innovations will be made in India. As more money is available for the companies to pump in to R&D
3.Indian IT infrastructure will improve.
I am not so happy for USA.
1. They are doing a big mistake on immigration. They do not have enough resources with right skill set.
I am not so happy for myself.
1. I am disappointed by the fact that USA is going in the wrong direction.

Will CIS generate the Receipt notice first before transfering the application to the appropriate service center. ( like transfering the application from NSC -> TSC when the I-140 was approved at TSC but filed at NSC) .

The one important thing people conveniently forget about CIR : the illegal aliens will NOT be able to apply immediately for a green card. Thats pure baloney being spread by vested interests like our self-appointed "Ombudman".
If you care to read the fine print, the original CIR has clearly mandated that all legal applications pending at the time of passage must be cleared before ANY illegal alien can apply for a green card. So assume CIR gets passed into law on 30 jan 2007 (OK that was overly optimistic :) ). All family-based and employment-based petitions with a PD prior to 30 Jan 2007 must be cleared before any illegal alien is eligible to apply. Anybody who has glanced at the visa bulletin might know that retrogression in FB goes back to 1980 in some categories. So, it may well be close to 25 years before any of today's illegal aliens can apply for a visa number. I would think that is sufficient time for congress to shore up USCIS to reach the strength required to process that many applications. This is the INTENT of the original CIR, what changes in the new (posibly more liberal ? ) version and how strictly USCIS will implement it is a different ball game altogether.
Realistically, it is highly unlikely that a democratic congress or the president will entertain standalone legislation like SKIL given the chances of CIR being revived. So chances are any relief we can get has to come through a comprehensive measure like CIR.
Assuming this congress and senate would favor CIR...

After 60 days have passed, it is less likely (but still risky) that USCIS will determine that the alien lied about his/her intent at the Consulate interview. And after 90 days, it is highly unlikely that USCIS will have a problem with the alien’s change of employment
Maybe this 30-60-90 rule applies to people with Consular Processing or someone who enters this country on Employment based GC and who leaves the employer right away after coming here.
For majority of people here in US, they might have already worked for a given employer for 3-6 years before they filed 485 and got their GC and completed their 6 months after AOS application to kick in AC21. Folks, until you have a US passport in your hand, you can profess love for this country as much as you like but the bottomline is that you are not a citizen. You will not be treated like a citizen and you will not have the rights of a citizen. Even after you have the US passport, "legally" your allegiance is to the US but that is not true of what the US feels about you. Your precious naturalized citizenship can be revoked at any time but that is not possible for a natural born citizen. This divide is real enough that if you kid asks you, "Daddy, why can't you become president?" then you need to know it that no matter how white your brown heart beats, the country on whose soil you were born is the only one which gives you every single right that is given to all its citizen, NOT the USofA.

DOL backlog gets cleared in 6 months. Return of Visa revalidation. Begin of I-140 premium processing etc. etc. Skill bill is too good.

This is just educated guesswork at this time. If you remember during the SJC deliberations on the CIR Sen. Durbin got the DREAM bill provisions inserted in the CIR as an amendment. On similar lines, I believe it is logical to asume that Sen. Cornyn, who basically is against the amnesty part of the CIR and an Republican will try to get his bill included as an amendment. My guess also is that in an effort to placate him and get his grudging approval for the entire bill, his amendment will pass the vote without much opposition, especially since he also has Sen. Lott (who I believe is the Dep. Maj. Leader) as a co-sponsor. Additionally, if the CIR were to pass, it would be almost impossible for any other legislation concerning immigration to pass this year or the next which also is an incentive for Sen. Cornyn to get this included in the CIR if he is serious about the SKIL bill.
This being said...nothing is as it appears and only time will tell...but, even if the bill is not included, I still believe that the CIR is better than what we currently have. I just saw the [previous post and it actually includes Sen. Cornyn in the same list as Hagel, Martinez, McCain.... wow :)
