    No one can travel on EAD. EAD is for employment authorization. AP is for travel. You cant mix and match the purpose of them.

    If you dont need to travel or if you have a valid H1 stamp for travel, dont file for AP. If you want to travel and if your stamp has expired and dont want to apply for new stamp, then file for AP.

    If you want to work for your employer and continue there and if you are sure of your job security, then you dont need EAD, and dont apply for EAD. However its a good idea since EAD is a great option of you are suddenly fired or laid off. EAD makes it easy to search for jobs coz the employer doesnt have to file your H1 and you can join them immediately without any hassles.

    Can you please provide me insight on my question?

    My company filed for my I485. i didnt file the EAD / AP at that time. I have a valid H1B stamped for multiple entry till 2010.
    So, as per your post, I can apply just for EAD, right? That is if I want to switch jobs after 180 days using AC21 and if I start using my EAD, can I go out and come back with my valid H1B stamping? Or do I need to have the AP since I have started using my EAD??
    Similarly, can my wife use her H4B even after she starts using the EAD instead of AP when she travels??

    Any help is greatly appreciated.

    In my opinion it is very naive to think that USCIS/DOL just realized that they had 'misinterpreted' the law. ..... The ambiguity of the law for the preference of vertical vs. horizontal spill-over allowed them to do that.


    In a couple of my previous posts I copied the relevant Sections (Sec. 202 and 203) of the INA which specifically states that distribution should be preferentially horizontal. Both Sections should be read together.

    Please note that there is no ambiguity in the law and DOS may just have taken too long to change the US Code or other relevant section of their rules.

    I will definitely be willing to change my interpretation if you can show where the ambiguity in the law lies. I'm definitely not a lawyer so it's quite possible that I'm missing some clause in the law.

    from doing that, what do you think you would achieve by the flowers being delivered at the hospital instead of the USCIS, the point has been made and the Director has acknowledged the effort - That was the end goal and infact the flowers will do more benefit to those in the hospital.

    Call the place where you've ordered flowers and ask for a refund if flowers are delivered elsewhere. It should be up to USCIS to recieve and then ship those flowers to the hospitals.

    That's good news APB.

    I guess it may either be the SR that I opened for my wife or the letter I wrote to Napolitano...my wife got a call from a CSR from DC and she told that her case is pending because of the Biometrics, she said she is issuing new biometrics...the speaker phone was on...and I interjected...how come I got approved w/o the Biometrics...she was clueless...I told her how many times can Biometrics notice be issued...my attorney called TSC on 10th of Sept and that time a notice was issued which we never received and then again two weeks later someone else issued another notice.....then someone else told that Biom is fine it just needs uploading and it has been two weeks since then the only thing that is happening is the Visas getting used up .....I said what's the point of FP/Biom if visas are no longer available which surely will be the case in 3 weeks....

    In any case didn't expect a phone call from them so was surprised.

    I was looking at all your posts and i can tell you how hard your trying to get your Wife's GC..Good Job Dude keep it up..i feel like you are fighting with USCIS to get GC...I am in a similar situtaion like you do but not same..i think my case has not been approved because of my wife's FP's was not able to read by FBI (she gave FP's 3 time in May) and never sent to USCIS by FBI..can you tell me how to escalate this issue to Napolitano or any other USCIS officals...:mad:

    VO doesnt keep your passport if a via not issued at the time of the interview . He gives it back after the interview. Once you receive the email , you have to go the VFS office and then had in the passport.

    If you get different A#s then definitely there is a possibility of delays in the application.
    I am not sure what happens with namechecks. Need to research further. My guess is you will have double chances of getting stuck in namechecks! This assumption is based on the fact that multiple filers need to undergo fingerprinting and background checks multiple times and thus chances of getting stuck in namechecks must also increase for them.

    i heard from my lawyer that we shoud combine them...will talk to him again on Friday...lets see wat he suggests...

    does anybody know the process of combining or withdrawing one set....

    The letter campaign resulted in 5000 odd letters from the entire EB community. This included efforts from some very hardworking IV people who did not spend time on the forums but went out and collected 100s of letters, one collected more than a thousand letters. So i am guessing that not more than 2000 EB folks got their collective butts to participate in the letter campaign.

    if you expect EB2 I and the so call US educated (i am too, hence i can use 'so called') folks to stop chatting on the forums and send money and letters in the tens of thousands, then please tell me want you smoke --- i would like to inhale some of that magic too.

    good luck towards your efforts. if you make it happen then, in all honesty, i would also like to nominate you to the core team, if you dont then i have a bridge in brooklyn that i want to sell.

    W2's/tax returns are not part of the initial evidence USCIS requires to process your application but they may ask for it later if required

    A lot of lawyers try to preempt a possible RFE by including "AS MUCH AS POSSIBLE" documentation. 3 years of tax returns prove nothing more than what 1 year of tax return would prove.

    Also, having a tax return of 2004 doesnt prove that you were in status at all times during 2004. Tax return shows total income that includes salary, bonus, deductions etc, and even Einstein cant figure out the immigration status in 2004 and whether the candidate was in good status at all times just by looking at the tax return.

    Some lawyers send many years' tax returns, thinking that it might pre-empt the RFEs. Some lawyers send only whats neccesary. I've heard that one of the lawyers in New York doesnt even send employer's letter. That means, basically nothing from the employer. And he too gets cases approved.

    Overloading the USCIS with a heavy file, sending a ton of things in addition to what they expect, may be a good strategy if you believe that it might thwart a RFE (and the delay caused by RFE). However, sending too thick a bunch, would also make your case look like a "difficult" case. (my belief, I dont know but just common sense would indicate that thicker bigger files are complicated cases if you give it a first look). And what that means is that it will get delayed because the CIS ombudsman report has documented that officers tend to work easy cases first (get the low hanging fruit first) and beef up their performance statistics by doing more cases in less time. Therefore, the complicated bigger cases that should be work on first, instead get worked on last.

    So think a little before sending USCIS 20 pounds of paperwork. More paperwork and overwhelming USCIS with documentation may not mean faster RFE-free processing. (Again, my belief - something to ponder about. But do what you think is right and what your lawyer tells you. I am not a lawyer).

    Let me help you understand why I think your question reeks not only of idiocracy, but also utter disregard for even basic moral and common sense.

    You wanted to buy a home, live in it for 2 years, sell it and make money. Nothing wrong with it. But, now that the market if not favorable to you, think you are not responsible for payment, and want to foreclose. All I'm saying is you are responsible for your actions; the act of buying a house, making sure you take care of it (read the contract where it says you are to take care and maintain the house to a reasonable standard), paying your monthly mortgage, insuring your home, and paying back the loan with interest by the end of the loan term. You signed the contract. You were ready to reap profits by the sale if there was equity on the home. Likewise you are to assume responsibility of payment if the home value depreciates. This is common sense. This is how the world has been. This is what they teach you as a kid. Why in the world are you complaining about depreciation when you knew this is a possibility when you bought the house?????????????????

    Foreclosing is not illegal. But in your case it is unethical. I'm not even sure if your lender will let you foreclose when you don't have a real financial burden to make regular payments. You are losing 20Gs only. I assume you are capable of paying your monthly payments. You want to relocate to get a better paying job. I do not think the lender will let you of the hook so easily. And why should they? They shouldn't. They should make you pay every single penny that you owe to them!

    And your questions about returning items to the store; you prove again that your a dishonest man! No, you cannot return a used item. It is wrong. Nothing legal about it. Who told you it is legal??? Now you may go back to the store and pretend like you didn't use it, or that the item is defective, and pass it off, but that's YOU!!!! In your own little dishonest mind everything that is in normal circumstances considered wrong is perfectly fine! You and your buddies here like "kumar1", "leo2606", think that it is fine to return used merchandise. You are all a bunch of dishonest people who didn't learn about right and wrong while growing up. Its not too late, go learn!

    this thread was started to get suggestions as to what are the options open in the market..
    if someone did give an option and you dont like it, why dont u give an alternative option rather than venting out uour anger.
    No one is asking you how u feel or what is ethical and non-ethical..It seems that you are such an ethical guy who has not used a product and went ahead and returned it back to the store..If foreclosing is illegal let me know.. People here are giving pros and cons of doing a foreclosure.. i dont know if you own a house or not, and if you do.. dont know if you are having a perm job or a contract..I know so many people who own house and now they are in a fix because of housing market..I am not like other people who have already foreclosed..and btw.. why to blame the people and not the banks.. if i can own a house and pay mortgage which is quite same as a rent, i will better own a house and sell it after couple of years.. what is harm in that.. i may have mentioned about making profit by owning a house.. but i am not looking at becoming rich by living in a house for 2/3 years..Sledge_hammer and you are complaining all the way in the thread about people who are foreclosing or foreclosed.. but not spent your valuable time in letting people, reading the thread, know what are pros and cons of foreclosure and how it can affect 485..

    Collected from some other forum . Just google search your name combinations ( within quotes ).

    For eg. if you have FirstName MiddleName LastName .

    The search should be ( put within quotes )

    "FirstName MiddleName"
    "FirstName LastName"
    "MiddleName LastName"

    and all the reverse combinations.

    If you get hits in 100s or 1000s , yeah you can wait 2 -3 years.

    I got 3 negs.. not that I care about the reputation system here... but it shows people are unwilling to confront me openly, and choose to hide even though this forum is already anonymous.


    One neg says:

    Why should I interfile? I am putting my energies into getting USCIS to follow the rules. It is the right thing to do, just because I am willing to wait for my turn, doesn't mean I will cede my position in the queue.

    Also, I am trying to take recourse from the written laws, there is nothing that anyone can do (barring USCIS' own impediment to follow the law) to not "let that happen".

    Using the same logic, they can avoid interviewing an African American.

    I think we all should get together and file a class action law suit against those companies.

    Yes, This comes into picture once company decides to hire. Now hiring is teh last process and beofre that you get grilled in multiple interviews. Employer is tsill at liberty not to interview EAD holder. If you are not interviewed, hiring would not come into picture and hence this text of law in I-9 form is worthless for you for that position. This I-9 text will only cover the situation for the period after hiring not before hiring.

    Folks,
    Today at 2:03 PM EST I received the coveted CPO mail for my wife. I was approved on Sept 3rd and was the primary and I have not yet received the CPO as there is Biometrics issue, my wife had the same issue but the vagaries of USCIS which is worse than Indian monsoon...

    I wish Caliguy, Fatjoe, Apb and many others who are at or older than my PD get their approval soon. If I can be of assistance in any way to you guys please let me know....My wife her case was separated from me and I was worried that it fell thru the cracks..but my persistence with all the channels especially congressional and POJ I guessed did it.

    Not that you guys are leaving any stone unturned but just keep trying...

    She was at initial review stage till Oct 2nd and not preadjudicated and separated from primary case and bingo on 5th she jumped to CPO...

    You really never know...

    Take care and I'll still be visiting IV and commenting and helping out..
