Civil infractions are leinennt, but you are now all set for rest of your life to be in public records. Future employers and creditors would see that too when they do background checks. Other than that you got nothing to worry about. Go ahead and continue to plan for your India visit. But may I advise not to indulge into that habit of shoplifting? ... uhmm I know gifts can be very expensive.:cool:

(1) The country of residence and country of nationality of the alien at the time such status is acquired.
(2) The country or countries in which the alien received the professional education and training to be licensed as a nurse.
(3) The name and address of the petitioning employer.
(4) The name and and address of any recruiting agency used by the petitioning employer with respect to the recruitment, processing or preparation of the alien for the employment involved.
(5) The processing time for review and action on the petition with respect to each such aliens.
(b) Research of Data From Prior Fiscal Years-
(1) With respect to the fiscal years 2006 through 2010, the Secretary shall determine which of the data required to be collected pursuant to subsection (a) are available for retrieval in electronic databases maintained by the Secretary.
(2) In preparing the report for fiscal year 2011 mandated by this section, the Secretary shall include a summary of all such available data for fiscal years 2006 through 2010.
(c) Reports- The Secretary shall submit annual reports aggregating the data collected under subsection (a), and, with respect to the report for fiscal year 2011, such additional data identified pursuant to subsection (b), along with such related information as the Secretary determines to be appropriate, to the Committees on the Judiciary of the House of Representatives and the Senate not later than 90 days after the end of each fiscal year. Such reports shall include--
(1) the aggregate number of aliens who acquired a status described in subsection (a) during such fiscal year and subtotals of the status categories acquired;

I am on H4 for past 2yrs. My H1 is valid since Oct07. I want to travel to India in Dec this yr. I have few questions:
1. I haven't started to work. So, what is my status as of now, after my H1 being aproved and valid since Oct1 2007?
2. My H4 is valid till Mar 2008. If I want to travel to India in Nov end and come back in Dec, do I need stamping on my H1 from the consulate.
If YES then:
Do I need to show any pay-stubs?
I NO then:
a. At the port of entry what status is I am supposed to declare?
b. If I enter as an H4 then does that invalidate my H1 visa?
Plz help!!

I tend to think a point system is better than what we have now. One thing though is that the points should be allocated "properly". For example, more points should be given to people with higher education, who earned a US degree, who have worked in the US for more years, who have paid more taxes, etc.
Someone mentioned a good point is about the visa number limits. If the per country limits are not eliminated, the points system won't solve the problem. Of course, they should also give more points to people who have passed Labor and I140 and allow them to adjust status right away. Otherwise, we will further get stuck in all the backlogs. Poor us. :(

Trust me my friend, I have seen it happen all the time, from large Telecom firm to Govt., its always there, most of the consultants just doesn't come to know about it, but the cut for the managers is there in some form, almost always. Why do each manager has a specific vendor through whom they want to hire most of the time? What else is the reason for the client to pay the consulting company $180/hr but they won't give 'valueablehurdle' anything more than $50-60/hr?
On a different note, now that NSG approved the waiver, most desi uncles, some of them are also owners of desi consulting companies will claim that they are the father of Nuclear deal. These bastards (sorry for my french) always oppose any GC fix and they tell their favorite congressman/senator (each has atleast one favorite politician for whom they do fund raisers) that gc backlog is not an important issue for the community. India Abroad, Times of India, rediff and other desi portals/newspapers will write 'Oliver North' style stories about these desi uncles knowing well that companies like GE etc put their weight behind the deal as it will create commerce to commerce over $20 billion/yr. But desi uncles/orgs will not stop claiming to be the father of nuclear deal. The fact is, most of these desi uncles made noise not because they wanted to do something for their country of birth, they are doing it because they think that if the nuclear deal passes, they can play middle man for US companies to sell the technology/material to Indian companies/govt. Most of the so called 'united voice of Indian-Americans on the Hill' organization's goal is to make big bucks by playing 'middle man' for companies wanting to sell technology to India. And as always, just as 'valuablehurdle''s client (paying $180/hr) Indian govt. will pay double the cost. These desi companies have squeezed blood of people waiting for gc, but now they think its time to move on to play big game with the big boys. Situation: Spouse came to US on H4 and then got converted to H1.Due to delay in pay and not a strong case, she is not willing to go for H1 visa stamping next time when she goes to India. She wasnts to go for H4 visa stamping instead.
1. Is it better to convert to H4 here and then leave for India? We feel that if it would take time to convert to H4, then instead of waiting she can work till the last day here and then quit and leave(because she wants to leave ASAP). Also changing from H1 to H4 here means submitting paystubs and other documents and more scrutiny. I think in Chennai consulate there will be less questions if applying for H4. Any thoughts, pl help?

This is not new, I was advised the same by my attorneys. I have heard "internet rumors" of people successfully filing EB-2 for job descriptions such as senior software engineer and senior systems analyst, which are normally classified as job zone 4. However, I was advised by two different law firms that this is not possible. According to both attorneys I consulted, you must get a job zone 5 classification to file EB-2. Note that "information technology manager" is job zone 5, so if you're in a senior position and supervising people (e.g., a manager or even a team lead), you may be able to obtain this classification.

When I applied for my labor , Even though , Ad is given for B.S and 7+ years of experience, My employer told me that My labor is applied on Eb3.
After my labor was cleared, when applying for I-140 , we had to change the attorney.The new attorney applied I-140 in EB2 category.
when I asked the new attorney about this , she informed me that , since I have got B.S and 10+ years of experience, I am eligible for EB2.
since I did not get to see the Labor clearance certificate, I dont know on what basis Labor is cleared.
Now I am confused whether I am in EB2 or EB3.

I just dont get it. A.R Rehman has been doing amazing work for ages now and it needed a British movie to take him to the world stage. Really, his work in Dil Se...was way better than what he did in Slumdog.
Bollywood sucks and how!!! They need to figure out how they can take their cinema to the world audience. They've been failing miserably in promoting their movies in the west. Americans welcome change and encourage talent always and our bollywood producers/directors need to tap that.

Bollywood sucks and how!!! They need to figure out how they can take their cinema to the world audience. They've been failing miserably in promoting their movies in the west. Americans welcome change and encourage talent always and our bollywood producers/directors need to tap that.

Guys please don't waste your time in dreaming for OCI, unless one of the parents has non Indian citizenship. PIO is the only option if both parents have Indian passport (citizenship).

So basically it was technical issue??? ... if someone heard what was going on in the senate and what the arguments were against this waiver please post...
May be the senators thought that it would increase the budget size or something???
My interpretation: the vote was not on Cornyn's amendment; in response to a Point of Order raised, there was a motion to waive the Budget Act for Cornyn's amendment (the Budget Act requires 60 "Yes" votes to bring to the floor amendments to appropriation bills); if 60 senators had voted "Yes" (and agreed to waive the Budget Act requirement for Cornyn's amendment), then a vote on the actual amendment would only have required a simple majority. But because only 55 voted "Yes", the amendment failed to obtain the waiver; it was out of order because it did not qualify as an amendment to this bill.
Because 40 Dems voted no on the waiver does not mean they are opposed to the amendment; they just did not want to vote on this amendment on this bill.

It appears that you are cracking a joke, but I cannot stop from replying to your post. Why are you asking God to save IV? For the things we cannot do or for the things we dcon't understand, why do we always have to bring in 'God' in the picture? Can't we even crack a joke without brining in God?
I am just trying to prevent world war III on these forums. Thats why my request for not referring "God'. We will all be much more happier funnier and peaceful if we try not to bring in 'God' in the mix.
