Visa recapture cannot happen with an administrative fix. Anyone who is telling you that visa recapture can happen by some admin fix or through a lawsuit is simply lying, possibly just to grab your attention. We have been repeatedly told by the administration that recapture cannot happen by an executive order.
A few days back a group of disorganized folks were writing to USCIS Director asking him to recapture. That is just a waste of time because CIS director cannot do recapture. Even Presidential executive order cannot recapture unused visas. It has to be done legislative because recapture will require change in the law.
We do not mean to dampen your enthusiasm but please do not expect for something that cannot happen. Recapture cannot happen with an administrative fix. In this admin fix initiative we are working on other possible good provisions that are possible.

I talked to USCIS information center at (202) 272-8269. They asked me to submit Form G-639 (it is available at www.uscis.gov --> under forms section). It has all the instructions to request the copies we needed.

"We should make it easier for the best and the brightest to come to start businesses and develop products and create jobs. Our laws should respect families following the rules, instead of splitting them apart," Obama said.
"We need to provide farms a legal way to hire the workers they rely on, and a path for those workers to earn legal status," he said.
The president said the system should stop penalising innocent young people for the actions of their parents, by denying them the chance to stay and contribute to build the country.
He said the presence of about 11 million illegal immigrants makes a mockery of all those who are going through the process of immigrating legally.
"Indeed, after years of patchwork fixes and ill-conceived revisions, the legal immigration system is as broken as the borders. Backlogs and bureaucracy means the process can take years," he observed.
He was quick to add that immigration reform has been held hostage to political posturing and special interest wrangling and to the pervasive sentiment in Washington that tackling such a thorny and emotional issue is inherently bad politics.
The president said besides addressing the issue of illegal immigrants, a reformed system also needs to address the need for talented people to stay and contribute to the country.
"While an applicant waits for approval, he or she is often forbidden from visiting the US, which means even husbands and wives may be forced to spend many years apart... High fees and need for lawyers may exclude worthy applicants.
"While we provide students from around the world visas to get engineering and computer science degrees at our top universities, our laws discourage them from using those skills to start a business or power a new industry right here in the United States," Obama said.
He said instead of training entrepreneurs to create jobs, "we train our competition", adding: "In sum, the system is broken, and everybody knows it".

Guys,
I have paper filed mine and my wife's AP on June 1st with Dallas Lock box ( I used priority mail and have tracking number ).
No email / alert for G-1145 , neither cheque got cashed.
Can you guys share your events please.

My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.
Any body in the same boat? What shall I do?

I am suprprised if IV is working towards abiltiy to file 485 and hard country limit...Just want to know how IV is working towards these 2 items...
If any of these two wont show out in coming bill,..then I would say goodbye to IV..because all other items in bill were there without IV;s interaction....
Can somebody calrify if these options will anyway include in this bill..by means of ammendements...
This is like someone in Sri Lanka saying that "if I don't get a blanket within 12 hours of the Tsunami, I will quit the Red Cross."
How about thinking, "if these items don't show up in the coming bill, I will become a more active member and work towards getting these items to show up at the next opportunity"?
It is probably not a good idea to treat our voluntary organization as if it were our butler. We're all part of this; we didn't "hire" IV to do this job for us.

Infopass appt for Interim EAD was not helpful at all.
They suggested the same that I did earlier, ie to fax USCIS hotline about my situation along with letter from emp saying that I am at risk of losing job.
I have done that several times, still no luck.
My EAD expires on aug 30th (yah, just 2 more business days).
Did everything in my hands, now just prepared to lose my job.
Surprising thing is I saw 2 soft LUDs on aug 25th and and 26th but still no approval nor RFE, case status still pending.
I know they are looking at my case, but doing nothing.
My wife's EAD was approved a month ago.
I asked my lawyer (from a big firm) if I will have a case on USCIS in case if I lose my job. She said, USCIS is famous for this kind of processing for 1000's still the cases wont stand against them.
I wld appreciate any suggestions/thoughts?
Efiled @ NSC on may 19th.
FP on july 3rd, still no approval.

1) Requested expedited processing via phone.
Received email saying to wait for next 30 days.
2) Called NSC, agent gave a fax number and asked me to provide Emp letter.
Faxed the Emp letter and also a covering letter.
3) 2 weeks passed, still no reply, called up NSC again, explained situation that I wld lose my job if i dont get EAD extension by this month end. She opened a Expedited request and told me to wait for 10 days.
4) As a back up, I also took infopass appoint for next monday (90 days will be over by then)
Believe me, its not easy going thru these phases.
I do not know how to reach my congressman/senator, Anyone here, pls let me know. I am from fremont, CA.

If my priority date is retrogressed at the time of processing my EAD and AP, will USCIS keep the EAD and AP on hold? Or will they process EAD and AP and hold the I485?

I am joining with Tek systems and they don't give as permanent position in offer letter rather just said contractor.. but I am full time with my current employer.
Do you think its going to be any problem from changing Full time to Contractor?
AC21 letter - wording is very important - the offer MUST be Permanant fulltime and the prospects for future employment must also be good - this is exactly what they request in a RFE or a NOID.
If your letter says it is temporary position, you will have issues.

On other thoughts its very much possible that someone leaked an early version of the Sept 10 VB. However the Sept 10 VB would have undergone revisions and may be different now. Just like the "leaked" USCIS memo on admin fixes some kind soul in DOS "leaked" this older/draft version of the VB out! As we know NOTHING is "leaked" by accident in Washington DC.
It would also mean BIG movement is coming from CY-2011 onwards as DOS is free to apply FB visas and do a quarterly spillover now.
