i upgraded on 6/19.no news yet. saw 2 times lud...
One of my friends who converted his I-140 to PP recently has got a response from USCIS saying that they will take 60 days instead of 15 days to reach to any conclusion. I am not sure whehter they av changed the rules under the hood but ready to announce it.
My I140 is stuck for almost a month now w/o any updates.

Hope you all are doing well.
I will join you folks. I was there at San Jose rally, DC rally and advocacy event, will be there this year. Good to see some of the returning folks. Last time California had more than forty members at the DC rally, probably the reflection of the state of economy and urgent need for immigration reform at that time. Time have changed and many people's circumstances have changed but our resolve is unchanged. Last time our advocacy effort impacted the lives of hundred of thousands of people who were able to apply for their EAD. Sweet victory for IV members and hats off to their leadership in this area.
Now, we work to help gather support for a CIR bill. I am excited about this. Lets do this.

I know, it is unfair and frustrating. But from legal point of view, you are mixing Employment Laws with Immigration Laws.

These ppl are talking about giving amnesty to ILLEGALS...let me repeat it.. amnesty=award for being ILLEGAL. They have done that before and all of a sudden we F'KIN LEGAL TEMP WORKERS from India/China have to worry about the LEGAL aspect of filing a law-suit.
Something is seriously screwed up with this. This is no different than a pseudo-SLAVERY. Now all of a sudden most of you will say, no one put a gun on your head to work. Ofcourse not, but why hell do they create a dual intent H1FU?K Visa where they show you the carrot and create a indentured servant system and discriminate on the basis of the country of your birth. It is discrimination. Trust me when there was SLAVERY in the US , it was defined LEGAL.

Lot of people get stuck in the name check in AOS, and many of them wait for at least 6 months. I am wondering if someone may get stuck in namcecheck and may have to wait for months in home country while doing cp?

The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing ED MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for ED Mubarak, I will be the first to welcome that step. You want to be American,, right? My company lawyer addressed this part. The way it works is that they will work on your file only when your PD is current. So even if you apply now, they most likely wont work on it after July as your PD wont be current. Then when next time (say in Jan 2008) when your PD becomes current, they will pick up all the files for that month and start working on it. It might be that they will work on your file on Jan1st or Jan 31st. You can send your wife AOS the moment your PD becomes current. So you want to make sure that it reaches there before they approve your AOS. In case you are extremely unlucky, then they would start working on your file on 1st day of the month and finish it before end of that day, making it impossible for your wife's application to go through. Thats rare though. So if you can make sure that her app reaches on 1st day of the month in which PD is current, then they should most likely add her to your AOS and work on those together and make your life go forward....its a chance which you will be taking...But again life is a chance

It is of no use to you unless you want to switch jobs on EAD which is a HUGE RISK!!My guess is you are going to get married at some point of time(Barring guys who are already in their midlife crisis b4 marriage) and would apply for your wife's Adjustment of Status. Please apply 485 togather when the PD bcomes current again. Bear in mind that even if you apply now b4 marriage you have to maintain your H1-B status. It will only make it worse when one had already applied for I-485 coz you could only get 1 year extensions as opposed to 3 years when you have an approved I-140 and have not filed for 485. Don't get overzealous and apply now and regret later!!

I mean, if I don't apply for AOS now, I am assured that me and my spouse can file together when PD becomes current and they will approve ONLY if my PD is current. Isn't that right? That could be five years away, but, my spouse will be able to piggyback on my GC processing.
Please remember that my fiancee is already on H1-B currently in India. I am from India too.

Thanks for your informed comments. Like you, I am also surprised to find many people in this forum, who are interested in fire arms.
I don't own a fire arm and not planning to while the immigration status is not yet Citizenship. I don't want the authorities to give another reason to look into my case. I just go for fishing once in a while.
But our family owns two guns in India and have worked with guns from childhood.
Another point is I am very much impressed with how the Americans manage wild life and the nature in general. They enjoy it while preserving it. India does neither. We just destroy it, and write eloquent speeches on nature protection.
Federal law does allow H-1Bs to purchase firearms if they have lived in the US (Same residence, if you move, the clock is reset) continuously (if you leave the country, the clock is again reset) for 90 days and fall under one of the 4 exceptions listed below.
- Possess a valid (unexpired) hunting license issued by any state in the US
- Are a Law enforcement officer from a foreign nation, here on official duty
- in the US to participate in a shooting sports competition
- get a waiver from the Attorney General
The easiest of these 4 exceptions is the Hunting license exception.
Once you meet the above mentioned criteria, you are okay, per federal law to possess a firearm. Doesn't matter what non-immigrant visa you are on (H-1B, F-1, AOS).
Next step is to check whether your state has additional restrictions. I don't think any states completely bars non-citizens from possessing firearms (atleast none of the states that I have lived in do), although some states have restrictions on the type of firearms non citizens can buy. e.g. in MA, non-citizens (including GC holders) can't buy handguns or high powered semi auto rifles (ARs, AKs) but they can buy non-large capacity rifles and shotguns.
As someone pointed out, trying out guns at a public range which has rentals is a great way to introduce oneself to the sport, learn basic firearm operation and safety, and to try a wide variety of guns and calibers.

We believe in this organization's hard work. Our presence here proves it. But I also think blaming members might not achieve anything except hostility.
If we do not get enough funds then we need to advertise IV. We need to have better web pages to have a look of a professional organization as compared to having a look of , lawyers website etc. For this we need ideas. We need better communication from IV administrators on their webpages. Right now if someone new comes to this website, it is does not look more than getting their immigration related questions answered. Plus their should be easy tabs to print IV advertisement for community boards, sending emails to friends to participate, or any other ideas. Also we need some form of direction of what to do and how to do it. Right now I don't even see easy tabs for access information from congressman, senators etc. Just throwing out some ideas. I am sure some other people have better ideas than I do.
Why dont you start by updating your profile, contributing money and volunteering your time to IV. You joined a couple days ago and have started lecturing IV admin as if you are an expert.
You came to the site and started dismissing IV flower campaign and praised AILA.
Why don't you volunteer for the site and its content and send an email to IV for it? And dont tell me you do not have time. If you do not have the time, then contribute money to IV because that is what I did too.

I'm also going to do a FOIA request for my I-140 that got approved in Jan 08. Employer is saying its their petition and they wont share it. I'm not going into argument because they revoke it now - The Legal Immigration system is too weak and too much lopsided to a "employer" rather than on the "individual employee"
I know during a PD porting to another AC21 employer this approval notice is sufficient even if the I-140 is revoked but my doubt is if my I-140 gets revoked can i switch to another employer and extend my H1B by 3 more years ??

I filed I-40 on June,1th 2007. My lawyer will file my I-485 & I-765 by July 1st. I'm currently on F1- status , When i can start working? do i get an authorization to work before approval of the I-40?
